SUBJECT:

LEGAL SERVICES FOR THE ADVISORY COMMITTEE ON REACTOR SAFEGUARDS In 1986, the Comission denied a request by the Advisory Committee on Reactor Safeguards to hire its own legal counsel.

The Comission wants to reiterate the direction it gave to the Comittee at that time.

The Office of the General Counsel is responsible for providing legal advice and services to the NRC on all matters which come before it, including any of the safety matters which may be reviewed by the ACRS.

Therefore, any legal advice on a matter before you for which the ACRS perceives a need should be obtained from the Office of the General Counsel. This means that no legal services may be obtained from outside the agency through hirin procurement efforts, or purchase of legal opinions or advice. g, one-time The General Counsel stands ready to respond to any requests for legal services which you may have.

If the ACRS is concerned about a legal interpretation of a statuta or regulation with respect to standards of conduct, the ACRS should ask the Office of the General Counsel to consult with the Office cf Government Ethics on the specific matter if this has not already been done.

If the ACRS is concerned about the policy impact of a legal interpretation with respect to standards of conduct, the ACRS should request the General l

Counsel to present the matter to the Commission for resolution, if this has not alret.dy been done.

If the ACRS is concerned about the impact of a legal interpretation rendered on substantive technical matters before the ACRS for its consideration, the ACRS should request the General Counsel to present the matter to the Commission for resolution.
