Dear Sirs,

Please find enclosed our requested response to yourletter of" NOTICE OF

VIOLATION", dated September 9,1993.

1.

Mr. Frank Morris, P.E. did use the Troxler 3400A portable gauge (serial Nuinber

14344) containing licensed material, without wearing a TLD badge on August 12,

1993. Mr. Morris was inspecting a large paving project that required density tests.

Our authorized user, Mr. Lars Gregovich, was busy inspecting another project.

Because of the importance of testing the density of the new pavement, and Mr.

Morris's background of using other portable nuclear density devices, he was allowed

to make density tests that day. On Monday, August 16,1993, a TLD badge 5 chip

was ordered from United States Dosimetry Technology Inc. for Mr. Morris. Mr.

Morris has carried and wom the badge since receiving it in late August 1993. In

addition, the stafrat Wilson Engineering has received additional training from the

Alaska Department of Transportation on September 8,1993 to further our

understanding and refresh our knowledge of radioactive materials.

2.

A. The shipping papers required to be canied during transport were in Mr.

Gregovich's auto during Mr. Morris's transport and use of the Troxler 3400A. Mr.

Morris took the Troxler 3400A from the locked storage unit without the required

shipping papers. On August 16,1993, a sign-out sheet containing the following

information designated user's name, time out/in, auto description & licenses #,

where taken, and confirmation that the shipping papers were taken, was installed at

the storage unit where the Troxler 3400A is confined. The user must now sign-

outlin and check off the fact that he has taken the shipping papers with the gauge.

All authorized users have been briefed on the importance of carrying the shipping

papers during transport of the Trcxler 3400A, and have been doing so since August

16,1993.

B. Mr. Lars Gregovich does have a locked and secure method of restraining the

gauge against movement in his tmck. On August 18,1993, Mr. Morris installed

metal eye bolts in his truck to which he has placed a wire cable through and around

the Troxler 3400A shipping case. This cable is then locked and the gauge braced and

attached to the truck to prevent movement during transportation of the gauge. All

future authorized user's will be requhed to undergo training in transporting the -

gauge. The Safety Officer, Mr. Jeffrey Wilson, will personally inspect the vehicles

used to transport the gauge, to ensure that the gauge is blocked and/or braced and

attached to the vehicle before allowing transportation of the gauge.

On August 16,1993, Mr. Gregovich cleaned and lubricated the gauge bottom plate

cover. On August 17,1993, a new bottom plate assembly and magnalube lubricant

was ordered from Troxler Labs. These were received on August 24,1993 and

installed on August 25,1993. The Troxler 3400A gauge tungsten shield now works

automatically to open and retract during gauge use. Review of the Troxler 3400A is

now made after each use. If problems or maintenance concerns are made, Mr. Lars

Gregovich will make allowable maintenance repairs immediately. The Troxler

3400A will be sent back to Troxler Labs this winter season to undergo a complete

rebuild and upgrade.

In addition to the above items, we have implemented and maintained records ofindividuals

designated as users of the moisture / density gauge containing licensed material, as required

by License Condition 11.

I hope this reply is found to be adequate. We have taken this inspection and noted

violations very seriously, and will make changes in our management involvement and will

actively control our radiation safety program.
