Dear Ms. Stein:
SUBJECT:
AMS SOURCE EXCHANGE CONTAINER AND OVERPACK SERIAL NO. 117 This letter is in response to your letter dated October 11, 1993, regarding use of Model Nos. 181375 and 181361 radioactive material packaging by J.L Shepherd and Associates.
From the information supplied in your letter, there does not appear to be a violation of NRC regulations. The issue you. raise is primarily a commercial one and is, therefore, not within the jurisdiction of this office.
My recommendation is that you may be better served by contacting the state office which regulates usage of radioactive packagings within that state.
Please note that California is an NRC Agreement State and has an office to' which you can convey your concerns.
In addition, please address all future correspondence regarding 10 CFR Part 71 quality assurance or sealed source safety issues to me and all correspondence regarding transportation issues to Mr. Charles J. Haughney, Chief, Storage and Transport Systems Branch. Should you have any further questions, please contact Stephen O'Connor (301-504-2460) of my staff.
