Dear Mr. Gilchrist:

On behalf of the Commission, I am responding to your letter of September 15, 1993, regarding NRC's proposed " Timeliness in Decommissioning of Materials Facilities" rulemaking (58 FR 4099-4110) and its applicability to uranium recovery facilities.

As published for public comment, section 40.42(f) of the proposed rule includes an exemption for tailings and waste disposal areas of uranium recovery facilities.

Your letter reiterates your April 19, 1993 comment on the proposed rule in requesting a blanket exemption from the requirements of the proposed timeliness in decommissioning rule for all components of uranium recovery facilities, including decommissioning of buildings and cleanup of land.

The NRC staff is currently evaluatir.J all comments that have been received on the proposed rule, including those ? the American Mining Congress.

I can assure you that your request, as well as the comments submitted in April, will be carefully considered in the preparation of the final rulemaking action.
