By letter dated July 31,1989, you requested a waiver of fees for Amendment-22 to GESTAR-II (NEDE-24011-P-A) because the report was of particular importance and use to the NRC. You were notified of the NRC's acceptance of Amendment 22 by letter dated July 23, 1990.

We apologize for the delay in responding to your letter.

reviews, and for the review of anj mendments, revisions, or supplements to

ts of inflation, and is an amount which approximates the median of topical report fees over $20,000 charged in 1939.- The Commission in establishing the new ceiling of $50,000 believes that the ceiling is fair, and should not inhibit the submittal of topical reports and their revisions.

In addition, the Commission will exempt all costs exceeding $50,000 for topical-report reviews completed on or af ter January 30, 1989.

The Office of Nuclear Reactor Regulation has reviewed your request and confirms that Amendment 22 to NEDE-24011-P-A is expected.to benefit both the NRC and the industry by eliminating the need for NRC review of new fuel designs. The purpose of the NRC's topical report program is to eliminate repetitive reviews. The fact that NRC may also derive benefits from the topical report does not diminish the vendor's responsibility for review costs. -Under the current fee regulation, General Electric will be charged for the professional staff hours and contractual costs expended for the 3

review of the report-up to the $50,000. ceiling.

In the near future, you will be receiving an invoice for the review costs of Amendment 22 to NEDE-24011-P-A.
