Dear Ms. Oge:
I am writing to inform you of developments related to the Memorandum of Understanding (M0U) between the U.S. Environmental Protection Agency, the U.S. Nuclear Regulatory Commission, and the States of Colorado, Texas, and Washington, concerning Clean Air Act standards for radon releases from uranium mill tailings (40 CFR Part 61, Subparts T ard W). The M00 requires that NRC and the States complete the review and approval of detailed reclamation plans and schedules for closure of non-operational tailings impoundments by September 1993.
By September 30, 1993, NRC and the States had approved all reclamation plans and amended all licenses for closure of licensed non-operational impoundments, with the exception of the Atlas mill site at Moab, Utah. This status was previously communicated in a letter from Michael Weber to Gail Bonano dated September 17, 1993.
For the Atlas site, NRC received extensive comments on the proposed reclamation plan approval, on the Environmental Assessment, and on the Finding of No Significant Impact published in the Federal Reaister on July 7.4; 1993. The actions necessary to be responsive to these comments made it impossible to meet the MOV imposed schedule.
NRC plans to complete a reassessment of the reclamation plan for the site and prepare a report with recommendations for future actions in November 1993.
Input will be obtained from Federal, State, and local representatives in this f
reassessment.
We are actively pursuing a timely final decision on the Atlas l
site location and reclamation plan and will keep you informed of our progress.
As the Atlas tailings impoundment dries sufficiently to allow access of equipment, an interim cover is being placed over the impoundment for radon emission control.
l Taking the extra time for further review of the proposed Atlas mill site reclamation plan by NRC will result in a final solution that is more responsive to public comment and will better protect the health and safety of the public.
