Toledo Edison has received Inspection Report 93021 (Log Number 1-2934)-

and provides the following response.

Violation:

10 CFR Part 55.53(i) states that, "The licensee shall have a biennial medical examination."

Contrary to the above, during the period from January 29, 1991, to November 5, 1993, one of your operators, licensed pursuant to 10 CFR Part 55, did not receive a medical examination. During this period of time, the subject operator performed licensed duties at Davis-Besse Nuclear Power Station as authorized under license number S0P 30971, issued effective June 27, 1989.

' Docket Number 50-346 License Number.NPF-3 Serial Number Page 2 Reason for the Violation Toledo Edison utilizes a manual tracking system for notifying licensed individuals when their biennial medical examinations should be scheduled. The manual. tracking system utilized to schedule biennial medical examinations is based on a " tickler" file concept. At the beginning of each month, the file is reviewed to identify if any medical examinations need to be scheduled. Memorandums

are issued to individuals and their_ supervision to notify them of the need to schedule the medical examination by a certain date. The individual and their supervision then ensure that the medical examinations are scheduled and completed.

On November 3, 1993, Toledo Edison personnel were compiling data of licensed operators' medical status far verification of compliance with 10 CFR 55.53(i) by NRC inspectors on site for an Operator Requalification Program inspection. During compilation of this data, Toledo Edison personnel identified that a licensed individual had not completed the required biennial medical examination.

In this case, the individual who missed the biennial medical examination was not notified to schedule the.

examination.

Due to a personnel error, the licensed individual's file was not checked during the month that the examination was due.

Corrective Actions Taken and Results Achieved A Potential Condition Adverse to Quality Report (93-0492) was initiated on November 3, 1993, to document the missed medical examination. The event was discussed among Nuclear Training, the Toledo Edison Health Center, Operations Section management, and the involved individual. The NRC inspectors'on. site for the Operator Requalification Program inspection were also informed of the missed biennial medical exam. A Unit Log entry was made on November 3, 1993, to require another individual to be present when this individual was performing licensed duties. This stipulation remained in effect until the medical examination for the' individual was satisfactorily completed.

A medical examination was conducted by the Toledo Edison Health Center on November 5, 1993, and results were received on November 8, 1993. These results' indicated no adverse medical condition had developed since the previous examination.

All licensed individuals' records were reviewed to ensure-no other medical examination dates were missed. This review was completed on November 5, 1993, with no other instances of missed examinations identified. The individual responsible for notifying licensed operators to schedule biennial medical examinations was counseled.

i Steps have been included in the administrative process to ensure biennial medical examination due dates are met.

These steps include increased oversight of the process and involve contacting the Toledo Edison Health Center.to ensure the individual schedules the medical examination i

and then completes the examination by the.due date. These steps were initiated on November 5, 1993, and vill continue in the future pending implementation of the Corrective Action to Prevent Recurrence discussed below.

j In addition, discussions with the NRC. inspectors on site for the Operator Requalification Program inspection-J identified that the practice utilized for scheduling biennial medical exams should be based on the operators' last physical date rather than the license date.

1 Accordingly, Toledo Edison has revised the administrative process to ensure biennial medical examinations are-conducted by'the end of the anniversary month in which the-operator was last examined. Two additional operators,-

whose medical eeaminations were due were examined by November 30, 199L As of this date, all licensed operators have hat a medical examination within the last two years.

Corrective Action to Prevent Recurrence In addition to the actions taken as mentioned above, Toledo Edison is evaluating an alternative to the manual

tracking system currently in use. This includes the utilization of a computer tracking system to reduce the j

possibility of human error allowing another physical 1

examination date being missed. The method for tracking medical examination dates vill be assessed by January 31, 1994.

Implementation of the revised tracking system vill be completed by April 29, 1994.
