NRC Inspection No. 50-271/93-22

An announced safety inspection of the radiation protection program at your facility was

conducted by Mr. J. Nick on September 20-24, 1993. The results of this inspection were

discussed with your staff on September 24,1993.

Areas reviewed during this inspection were important to health and safety and are discussed in

the enclosed inspection report. These areas included review of: organization and staffing levels,

staff qualifications and training, external exposure control, internal exposure control, radioactive

and contaminated material controls, radiological surveys, radiation protection logs and records,

'

and' planning to maintain personnel radiation exposure as low as reasonably achievable

. (ALARA).

.

.Your radiological controls program was generally effective in protecting the safety of work.ers

in radiological areas.' Areas toured in your facility were well maintained and exhibited good

housekeeping with the exception of some contaminated areas. The radiation protection group

,

was staffed by qualified individuals with documented training and qualifications. Improvements

were noted in the automation of access control, staffing levels for radiation protection

.

' technicians, and lower overall radiation dose rates. Weaknesses were noted in the identification

,

/

of poor housekeeping in contaminated areas, attention to detail in training records, and control

-of radioactive and contaminated material.

Within the scope of this inspection, one violation was identified regarding the control of

- ' personnel access to high radiation' areas to prevent inadvertent entry, and is described in the

attached inspection report and Notice of Violation. You are required to respond to this letter

and should follow the instructions specified in the enclosed Notice when preparing your

.

response. In your response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this Notice, including

your proposed corrective actions and the results of future inspections, the NRC will determine

whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory

requirements.

APPENDIX A

NOTICE OF VIOLATION

. Vermont Yankee Nuclear Power Corporation

Docket No. 50-271

Vermont Yankee Nuclear Generating Station

License No. DPR-28

During an NRC inspection' conducted on September 20-24, 1993, a violation of NRC

requirements was identified. In accordance with the " General Statement of Policy and Procedure

for NRC Enforcement Actions",10 CFR Part 2, Appendix C (1993), the violation is listed

below:

(A)

' 10 CFR 20.1601(b) states in part that "in place of the controls required by paragraph (a)

of this section for a high radiation area, the licensee may substitute continuous direct or

electronic surveillance that is capable of preventing unauthorized entry."

.(B)

Technical Specification (TS) 6.5.B.1 states, in part, that "In lieu of the " control device"

or " alarm signal" required by paragraph 20.1601(a)(1) of 10 CFR 20, each high radiation

area in which the intensity of radiation is greater than 100 mrem /hr at 30 cm, but less

,

t

than 1000 mrem /hr at 30 cm, shall be barricaded and conspicuously posted as a high

radiation area and entrance thereto shall be controlled by requiring issuance of a

Radiation Work Permit (RWP)."

' Contrary to (A) and (B) above, on September 21 and 22,1993, the inspector found two

. examples of high radiation areas (one also a contamination area) which did not properly control

access to prevent inadvertent 'or unauthorized entry. The high radiation areas without proper

access controls were found at the personnel entrance to the drywell and on the lower elevation

_

of the torus room. The duration of this condition was indeterminable.

- The examples listed above constitute a Severity Level W violation. (Supplement IV)

i

Pursuant to the provisions of 10 CFR 2.201, Vermont Yankee Nuclear Power Corporation is

hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory

Commi_ssion,- ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the

Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that

is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of

Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation"

and should include for each violation: (1) the reason for the violation, or, if contested, the basis

for disputing the violation, (2) the corrective steps that have been taken and the results achieved,.

(3) the corrective steps that will be taken to avoid further violations, and (4) the date when full

compliance will be achieved. If an adequate reply is not received within the time specified in

this Notice, an order or a Demand for Information may be issued to show cause why the license

should not be modified, suspended, or revoked, or why such other action as may be proper

should not be taken. Where good cause is shown, consideration will be given to extending the

. response time.
