Dear Jane:

j During the meeting I attended with you on September 26,'1993, and at the various public meetings held by the.raview team for reassessment of the NRC program for protecting allegers against retaliation representatives of the National Nuclear Safety Network (NNSN) have requested that the makeup of the Review Team be expanded to include.two representatives of NNSN.

In addition, during the October 7, 1993 public meeting in New London, Connecticut, you requested that NRC' establish a permanent Citizens Advisory Board to address ongoing concerns _of whistleblowers. I have shared these requests with James Taylor, the NRC Executive Director for Operations and provided him a copy of your October 7, 1993 statement.

Both of these requests would require establishing Federal i

Advisory Committees.

By Executive Order 12838, dated February 10, 1993, the President has directed that each agency rejustify the need for each of its advisory committees and reduce the number of advisory committees.

In accordance with this Executive Order to establish a new advisory committee requires a compelling reason and approval by the Director.of the Office of Management and Budget.

An advisory committee also has associated.with it numerous procedural requirements that may make itidifficult to complete the review in a timely manner.

It is important to gain as many perspectives and. ideas as possible in developing the basis for the. Review Team's effort.

We have actively sought advice on how we should change the 1

regulatory process in this area.

However, we believe using our staff is the most efficient and appropriate way to come up with recommendations for changing the process after considering a wide range of views including those from the NNSN.

Therefore, after-discussing your request with Mr. Taylor, we do not intend to request the Commission expand the Review Team into an advisory committee.

Please note that, while the Review Team has received comments from licensees and at least one industry group, we have not granted any spedial status to any, nor has anyone other than NRC employees made part of the Review Team.

OCT 2 0 993 Ms. Jane Fleming The Review team recognizes the relevancy of the views of workers, as after all, the issue is whether employees feel free to raise safety issues without fear of reta)'ation.

As part of its efforts, the Review team is considering the need and ways to periodically get the views of workers in the nuclear industry.

In any event, to the extent the NNSN desires to publicly meet with the staff and present its views on worker issues, please contact me.

We would be pleased to consider such meetings as we would any other group that may have relevant information to provide the agency.
