Dear Mr. Chernoff:
The U.S. Nuclear Regulatory Commission staff has cor:pleted its revim of the preliminary final Remedial Action Plan (RAP) and associated documents for the-inactive uranium mill tailings site at Naturita, Colorado, transmitted with your letter dated August 13, 1993. The staff review has identified significant issues that remain to be resolved, and, therefore, we cannot concur in the RAP at this time.
The issues, in the areas of Surface Water Hydrology and Erosion Protection, Water Resources Protect lon, and Radon Attenuation and Site Cleanup, that need to be resolved, have been identified and discussed in the relevant sections of the enclosed Technical Evaluation Report (TER).
Due to conflicting casework, we were unable to complete the detailed write-up on the groundwater review at this time. However, general conclusions and open issues are included in this draft TER, and the completed Section 5.0 will follow as soon as schedule permits.
In order for the NRC staff to complete a final TER and concur in the RAP, all issues must be satisfactorily addressed. The information to resolve the open issues may be provided by RAP page changes.
