SUBJECT:

REQUEST FOR INCREASED PUBLIC AND STATE NOTIFICATION ON RECEIPT OF BRC PETITIONS On July 10, 1990, Paul Lohaus, B. J. Holt, and James Kennedy attended a meeting of the Michigan Department of Public Health's Low-Level Radioactive Waste Regulatory Advisory Committee to discuss and respond to questions raised by the Comittee in three areas:

(1) Michigan's role and regulatory responsibility as an agreement versus a non-agreement state; (2) Storage of LLW which may be required of Michigan generators if access is denied in mid-November by the sited states; and (3) NRC's BRC Policy Statement.

During the question and answer portion of the meeting, public representatives asked about the procedures NRC would follow in notifying the public and states that a petition for rulemaking for an exemption had been received by NRC and that NRC had requested public refiew and comment. Paul Lohaus responded that NRC's intent, as stated in the policy, was to have broad and full public comment and participation as a part of NRC's evaluation and decision process on any rulemaking petition. Questions were subsequently directed at the process NRC would follow to make this information available and known to the public.

He responded that the petitions would be published in the Federal R6gister, copies would be available in local libraries or PDR's that maintain copies of the Federal Register and copies would be provided to the states under our exchange of information program.

Public representatives expressed desire that NRC also consider other mechanisms for public notification since few individuals have direct access to the Federal Register or live near the local PDR's. He indicated that he would check to see what additional nachanisms were being considered and carry forward the comment within NRC that additional mechanisms should be considered to help ensure the public was informed of the receipt of petitions, Lee Jager, Michigan State Liaison Officer, requested that a specific mechanism be developed by NRC to notify him, as State Liaison Officer, of any petitions received which, in turn, may assist in helping inform local and interested menbrs of the public. Paul indicated we would also carry forward his request to f

The BRC steering group has previously considered this issue although no specific additional actions to inform the public, such as a press release, are presently planned.

I suggest we discuss this issue further and, as a minimum, respond positively to Lee Jager's request.
