citizens who will be affected by the Appeal Board's decision in this proceeding live.- 1 H

As both you and Representative Kostmayer know, I have long  ;

- been concerned about " roadblocks" to citizen participation in NRC- i

- licensing proceedings. Since such an economic disparity exists between the regulators, the regulated, and citizen Intervenors, I believe that it is both fundsmentally unfair and a violation of the -

e spirit of .the' Atomic -Energy Act .to hold any session of citizen intervention proceeding in Bethesda, Maryland. It is not only an economic burden to the citizens who are participating, itL also .

removes the proceeding- from the area:where the citizens whose

- health and safety could be affected by the Appeal Board decision.

Another factor which I would like to bring to your attention-

. is the. fact that on May 24, 1990, the Advisory Committee on Reactor Safeguards (ARCS) of the NRC held a meeting in West Palm Beach, ,

Florida on the issue of pressure vessel embrittlement. As you know, the. technical < issue of embrittlement of the Turkey Point.

reactor pressure vessels is the subject matter of this proceeding.

Yet, Intervenors were given no notice by the NRC of this.very '

important meeting which was being held in our geographical INVOLVEMENT LITIGATION NUCLEAR INFORMATION

vicinity, nor has the NRC provided us with a copy of the transcript of this meeting which addressed the Turkey Point nuclear plant.

Additionally, although I an on the Atlanta Region's news release list, I did not receive the news release that was sent out 1 concerning the ACRS meeting. Because the scientific views that were expressed at this meeting could be important to the Atomic Safety and Licensing Board proceeding that we are presently.

involved in, I am asking that you (a) question the NRC as to why we

were not informed of the meeting, and (b) obtain a copy of the t anscript of the May 24, 1990, ACRS meeting so that our '

organization can review it. ,
