Dear Senator Breaux:
I am responding to your letter of' July 6,1990, in which you requested information for a constituent on a Nuclear Regulatory Commission (NRC) activity involvi-low-level radioactive waste disposals.
I have enclosed a copy of our recentif issued Below Regulatory Concern (BRC) Polic companion explanatory booklet (Enclosure 2)y Statement (Enclosure 1) and a which should help your constituent understand the basis for the policy and how it will be implemented.
I would point out that this policy is not self-executing and, by itself, does not exempt anything, including any low-level waste, from regulatory control.
Rather, the policy provides the principles and criteria that would be applied in making such decisions through our rulemaking or licensing processes.
In either process, the Commission has made a commitment to provide an opportunity for public comment and will consider public views in deciding on the need for specific controls or conditions on exemptions granted in implementing the policy.
