Dear Mr. Jager:

I am responding to your July 19, 1990 letter asking for coments on the summaries of our July 10, 1990 meeting with the Low-Level Radioactive Waste Regulatory Advisory Comittee and meeting with Department and Authority staff on LLW storage issues. We were pleased to have an opportunity to participate in the meetings and believe the summary enclosed witi your letter characterizes points of discussion and NRC staff responses to specific questions raised during the meetings. Our specific comments are enclosed.

During the Advisory Comittee meeting, we offered to provide the Comittee copies of documents and additional information dealing with a number of areas covered during discussion at the meeting.

I have listed below specific documents and correspondence based on a review of my notes taken at the meeting and documents spscifically identified in your summary.

1.

NUREG/CR-1759 Vol. 1 and NUREG/CR-5431. These documents provide background information on the history and experience at operating and closed LLW disposal facilities.

2.

Copy of Generic Letters 81-38 and 85-14 and Information Notices 89-13 and 90-09 which provide information on storage of LLW.

3.

Copy of an article regarding monitoring at landfills and additional information covering issues in this area.

4.

Copy of the three BRC petitions currently under NRC review.

5.

Copy of NRC comments on the Clean Air Act.

6.

Copy of a January 19, 1990 letter from Chairman Carr to Senator Breaux regarding the BEIR V report.

7.

Copy of NUREG/BR-0121 on Part 61.

Copy of several specific Subagreements with States discussed during the meeting.

In this regard, NRC and Michigan are currently negotiating an agreement regarding cooperation in the transfer of reactor plant data via the Emergency Response Data System during emergencies at nuclear oower plants.

Finally, I have identified the issue regarding increased state and public notification of NRC's receipt of any BRC petition, and specific notification to you as State Liaison Officer, discussed during the Advisory Committee meeting for follow.up consideration within NRC.
