This refers to the special announced safety inspection conducted by Mr. J.

Roth of this office on June 21 and July 18, 1990 at the Buffalo Materials

Research Center in Buffalo, New York, for the purpose of. reviewing procedures

and actions taken to transfer irradiated fuel assemblies from the reactor tank

into the adjacent hot cell for temporary storage and to discussions of our

findings held by Mr. Roth with Mr. L. Henry and others of his staff at the

conclusion of the inspection.

Areas examined during this inspection are described in the NRC Region I.

Inspection Report which is enclosed with this letter. Within these areas, the

inspection consisted of selective examination of procedures and representative

p

records, interviews with personnel, and observations by the inspector.

,

No reply- to this le+.ter is required.

However, during this inspection, an

apparent violatien, concerning the movement of a fuel assembly in the reactor

tank without the approval of the Fuel Transfer Supervisor was identified.

This violation was reviewed and found to meet the mitigative. tests described

in 10 CFR 2, Appendix C; consequently, no Notice of Violation is being issued

for this violation.

In addition, during this inspection, Mr. Henry committed to provide this office

with detailed procedures. prior to first use of the procedures for the removal

of ' activated reactor components from-the reactor tank and their storage. Your

cooperation.with us is appreciated.
