This is to inform you, in accordance with the requirements of the Nuclear Non-Proliferation Act, that the NRC has not completed licensing action on your license application XSNM02748 for the export of high enriched uranium to France for recovery and down blending to low enriched uranium.
l Favorable Executive Branch views on this application were received by the NRC on October 8,1993, followed by the Department of Defense letter, addressing the necessary determinations pursuant to Section 133 of the Atomic Energy Act, which was received on October 26. The staff has been reviewing the case to determine whether all criteria of the Atomic Energy Act, as amended by the Nuclear Non-Proliferation Act and the Energy Policy Act of 1992, have.been met. Additionally, the staff has been addressing the Petition of the Nuclear Control Institute for Leave to Intervene and Request for Hearing, dated June 24, 1993. Staff review will be completed soon and a recommendation will be forwarded to the Commission in the near future.
