Dear Congressman Klein:
I am responding to your request of November 2, 1993, for.information on the status of applications, before the U.S. Nuclear Regulatory Commission, to receive a license to receive, store, and dispose of uranium and thorium byproduct material (as defined in Section 11e.(2) of.the Atomic Energy Act (AEA) of 1954, as amended).
Your letter identified four specific sites:
TEXCOR, Dawn Mining Company, UMETCO, and Envirocare. Of these sites, only one, Envirocare of Utah, Inc. (Envirocare), had an application before NRC.
NRC issued Envirocare its license on November 19, 1993. The remaining sites are under the jurisdiction of Agreement States, under Section 2741 of the AEA.
The status of each of these sites is provided as an enclosure to this letter.
There are currently no other pending applications for licenses to commercially dispose of large quantities of 11e.(2) byproduct material.

A APPLICATIONS FOR RECEIPT, STORAGE, AND' DISPOSAL OF 11e.(2) BYPRODUCT MATERIAL TEXCOR Site in Kinney County. Texas:
TEXCOR submitted their application to the Texas Department of Health in 1989.
The Texas Department of Health issued an Environmental Assessment (TBRC EA-19) on April 5,
1991.
The responsibility for regulating ~ this facility was' transferred to the Texas Water Commission in 1992. On June 30, 1993, the Texas Water Commission denied the license application based on insufficient information. On September 1,1993, the Texas Water Commission became the Texas Natural Resource Conservation Commission. The denial is pending a rehearing of an appeal before the Texas Natural Resource Conservation Commission.
Dawn Minino Comnany in Ford. Washinaton:
Dawn Mining Company submitted a preliminary application to receive lle.(2) byproduct material from other individuals in April 1993.
The State is in the process of reviewing the application for disposal of lle.(2) material at the Dawn Mill site.
It is anticipated that the State will make a determination on this application by August 1994.
UMETC0 Facility in Colorado:
On June 30, 1992, Umetco Minerals Corporation submitted an application to amend their license for the Umetco Uravan site. The request was to receive' and dispose of radioactive materials in the form of mill tailings, contaminated soils, and contaminated debris from various uranium, thorium, and vanadium sites and_other sites within Colorado. The license application was reviewed by the State and the State published, in January 1993, a preliminary licensing statement including a proposed license. After conducting a hearing in late April and early May 1993, the hearing officer found that Umetco's license be amended as proposed by the State of Colorado. This decision was subsequently appealed. The appeal process is still under way.
Envirocare Site in Clive. Utah The U.S. Nuclear Regulatory Commission has completed the review process and issued a license to Envirocare of Utah, Inc., on November 19, 1993, to receive, store, and dispose of lle.(2) byproduct material.
In support of this licensing
- action, the staff documented its safety review of Envirocare's-license application in the Final Safety Evaluation Report dated June 18, 1993, and Supplement 1 issued September 7, 1993.
The environmental review of the licensee's Environmental Report is documented in the Final Environmental Impact Statement issued September 13, 1993.
