Dear Chairman Lampert:

Your letter to Chairman Selin dated September 2,1993 has been forwarded to me for response.

You requested the NRC to impose a moratorium on granting Agreement State status to current applicants and Massachusetts in particular, pending completion of all reviews of the Agreement State program.

It is our conclusion that a moratorium on signing Agreements under section 274b of the Atomic Energy Act is not necessary.

At the direction of the Commission, extensive reviews of the Agreement State program are underway which among other things will address the findings of the General Accounting Office and the Congressional inquiries into the program.

In addition, the Commission is more directly involved with the activities of the Agreement States program and is comitted to assuring safe and compatible radiation control programs in all Agreement States.

With respect to the application by Governor Weld, the NRC staff has conducted a preliminary review of the proposed program. This review has raised a number i

of issues. Our review of the formal application package, which has not yet been received, will be detailed and rigorous in order to ensure that the public health and safety will be adequately protected if Massachusetts becomes an Agreement State.

Dear Congressman Studds:

This is in response to your letter of September 14, 1993 to Dennis Rathbun, Director, Office of Congressional Affairs, which forwarded a copy of a letter from your constituent, Mary Elizabeth Lampert, Chair, Duxbury Nuclear Advisory Comittee, urging NRC to impose a moratorium on entering into new Agreements with States under section 274b of the Atomic Energy Act.

Despite recent criticisms of the Agreement States program, the Nuclear Regulatory Comission (NRC) continues to believe that the program is fundamentally sound and that the programs administered by the present Agreement States adequately protect public health and safety.

For this reason, NRC does not believe that a moratorium on signing new agreements is necessary. However, this does not mean that improvements to the Agreement States Program are not being planned. At the direction of the Comission, extensive reviews of the Agreement State program are underway which among other things will address the findings of the General Accounting office and the Congressional inquiries into the program.

In addition, the Comission is more directly involved with the activities of the Agreement States program and
