' SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS. 50-313/90-24;
50-368/90-24)
This refers to the Operational Safety Team Inspection conducted by
Mr. J. E. Cumins and other NRC personnel from September 10-21, 1990. At the
,
conclusion of the inspection, the team discussed the findirigs with you and
members of your staff identified in Attachment A of the enclosed inspection
report.-
Areas examined during the inspection are identified in the report. The
inspection team reviewed activities in the areas'of operations, maintenance,
engineering and' technical support, management oversight, safety review, and
corrective action. Within these areas, the inspection consisted of selective
examinations of procedures and representative records, interviews with
personnel, and observation of activities in progress. The team observed
i
approximately 80. hours of onshift, operations-related activities including
backshift and weakend inspections.
Based on the results of this inspection, certain of your activities appeared to
be in violation of NRC requirements, as specified in the enclosed Notice of
,
Violation (Notice). You are required to respond to this? letter and should
-follow the instructions specified in the enclosed Notice when preparing your
<
response.
In your response, you should document the specific actions taken and
any additional actions you plan.to prevent recurrence. After reviewing your
response to this Notice, including your proposed corrective actions and the
results of future inspections, the NRC will determine whether further NRC
enforcement action is necessary to ensure compliance with NRC regulatory
requirements.

Because of the potential safety significance of the items related to the failure
to test certain safety-related instrument air check valves and to respond
accurtely to Generic Letter 88-14- discussed in Section 2.1.7 of the enclosed

inspection report), Region IV conducted a followup onsite inspection of
activities related to these items during October 1-5, 1990.
The results of that
inspection were detailed in NRC Inspection P,eport 50-313/90-38; 50-368/90-38,
and an enforcement conference was held in the Region IV office on October 30,
.

On balance, the inspection findings were positive; changes made in management,
organization and programs appeared to have been effective.
Two unresolved items are discussed in Sections 2.2.2 and 2.2.3 of the enclosed
report.
This report includes specific inspection followup fcr selected Diagnostic
EvaluationTeamfindings(referenceDiagnosticEvaluationTeamReportissued
December 21,1989). These are discussed in the Executive Sunmary and in

paragraphs 2.1.3 and 2.1.4 of this report.

In a:cordance with 10 CFR 2.790 of the NRC's- " Rules of Practice," a copy of
this letter and its enclosures will be placed in the llRC Public Document Room.

The response directed by this letter and the accompanying Notice is>not subject
to the clearance procedures of the' Office of Hanagement and Budget as required
by the Paperwork Reduction Act of 1980, PL 96-511.
