CONFIRMATORY ACTION LETTER This is in reference to your finding, upon a post-loading inspection, a crack on one hinge on a Super Tiger shipping container, a Model No. 6400 package, Certificate of Compliance No. 6400.
Pursuant to telephone conversations between Mr. E. W. Brach and Mr. J. Philip Stohr of the NRC, and you on November 17, 1993, it is our understanding that you will take the following actions immediately:
l.
Temporarily suspend shipments of radioactive materials in the Model No. 6400 package (all three units),
2.
Ensure that any packagings used for shipment of radioactive materials conform to the conditions listed in the Certificate of Compliance for that packaging, and that the packagings are in unimpaired physical condition, and 3.
Discontinue use of any of the packagings for radioactive materials shipments until such use is discussed with the NRC and the NRC agrees to such use.
In addition, it is also our understar< ding that you intend to ship empty packaging from Oak Ridge National Laboratory to your facility in Erwin, Tennessee, that this packaging has been inspected and found to be in unimpaired physical condition, and that the use of this packaging will be in accordance with 2 and 3 above.
Pursuant to Section 182 of the Atomic Energy Act, 42 U.S.C. 2232, and k
10 CFR 2.204, you are required to:

Notify me immediately if your understanding differs from that set forth
- above, 2.
Notify me if for any reason you cannot complete the actions as outlined above and advise me in writing of your changes, and 3.
Notify me in writing when you have completed the actions addressed in this Confirmatory Action Letter.

2 Issuance of this Confirmatory Action Letter does not preclude issuance of an order formalizing the above commitments or requiring other actions on the part of the licensee. Nor does it preclude the NRC from taking enforcement action for violations of NRC requirements that may have prompted the issuance of this letter.
In addition, failure to take the actions addressed in this Confirmatory Action Letter may result in enforcement action.
The responses directed by this letter are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter will be placed in the NRC Public Document Room.
