AFFIDAVIT OF ZOLTAN R. ROSZTOCZY I, Zoltan R. Rosztoczy, being duly sworn, do depose and state:

1. I am employed as Chief, Equipment Qualification Branch, in the Office of Nuclear Reactor Regulation , U.S. Nuclear Regulatory Commission. A copy of my professional qualifications appears in the record of the THI-1 Restart Proceeding following tran-script page 6927-A.
2. The purpose of this affidavit is to provide a response to Item III.G of the Appeal Board's Order of July 14, 1982.
3. In Item III.G. the Appeal Board asked about the current Staff position on environmental qualification of the equipment needed to provide one path for achieving cold shutdown. It also asked how the health and safety of the public will be adequately protected if the requirement to qualify one path for achieving cold shutdown is deleted

The Staff's current position is as set forth in SECY-82-207C,

" Final Rule, Environment Qualification of Electric Equipment

, Important to Safety for Nuclear Power Plants," dated July 27, 1982. In discussion item number six of that document the Staff noted that TMI-1 is one of eleven plants for which sufficient information has been provided in response to Supplement No. 3 to IE Bulletin 79-01B to initiate a review. The Staff also noted there its general agreement with the conclusions of its contractor, the Franklin Research Institute. The contractor, based on its brief review of the information submitted for the eleven plants, concluded the information indicates that, to achieve cold shutdown, little if any, equipment beyond that needed to achieve hot shutdown is required; that a large percentage of the equipment needed to achieve cold shutdown is the same type already required to be qualified to reach hot shutdown; and that another large percentage of the equipment needed to achieve cold shutdown is located in mild rather than harsh environment areas.

As the Licensing Board stated, "[t]here is no evidence that the lack of environmental qualification of the equip-ment that is used to bring the plant to cold shutdown is such an urgent matter that interim operations should not

itself determined in connection with its promulgation of

, interim rule 10 CFR 50.49 that operation of plants pending completion of the equipment qualification program will not present undue risk to the public health and safety. 47 Fed.
