RE: PROPOSED AMENDMENTS 'IO EMERGENCY PLAN Dear Administrative Judges Yesterday I received a copy of Mr. Cormier's letter, dated August 2, regarding Applicant's proposed amendments to its emergency plan.

However, a copy of the proposed amendments was not included.

I note in Mr. Cormier's cover letter, however, the suggestion that the Board now schedule additional discovery and motions for summary disposition related to the emergency plan contention.

We feel such scheduling is not appropriate until full service of the proposed amendments to the plan is completed and CBG has been given l reasonable time to review the plan and determine what discovery we may need l

thereon.

Furthermore, we note that the Staff indicated at the prehearing conference that its supplement to the SER addressing the emergency plan was scheduled to be issued on July 31 (TR 633, 640). Determination of the

- " amount and the time of discovery, if any, which CBG wishes to submit on these amendments to the application and the revised emrgency plan, and the l

Staff's evaluation of the emergency plan" (TR 633) should await, in CBG's view, release of that Staff SER supplement on the emergency plan. Given the target date of July 31 given by Staff, that supplement should be received any day now.
