RE: SERVICE IRREGULARITIES
Dear Mr. Cormier:
For the third time in the last three weeks I have received from you incomplete service of documents.
In each case, I (and others on the Bridge the Gap service list) have received only a letter of transmittal, not the enclosures. In the most recent case, I did not receive the amended emergency plan you are formally submitting to replace the plan in the 1980 Application.
In addition, you have failed to serve the other amendments to the application on the full service lists only the CBG office in Los Angeles has receivc' a copy.
Furthermore, o er the last few months, date of service as indicated by postmark was different than the date indicated on the service notice (atai required to be met by the regulations or the Board-ordered schedule) in nearly a_ dozen instances. While one can understand if occasionally a pleading is dropped in a U.S. mail box at the appropriate time and through some delay at the post office it is not postmarked until the following day, that does not appear to be the case with the University as its pleadings are postmarked by University-owned and -controlled postage meters.
The problems caused by repeated tardy service are obvious.
It took nearly a year to get you to meet your obligations to serve us with Staff-Applicant correspondence.
I trust it will not take that long--nor the necessity of obtaining Loard direction--to get you to make complete service and comply with filing deadlines in the future.
In the meantime, please serve copies of the new Emergency Plan ani the 4-30-82 amendments to Ms. Rompson and Mr Bay,,afid to myself in Ben Lomond.
