..-o APPENDIX A NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-423 Millstone Nuclear Power Station Unit 3 License No. NPF-49 During a routine resident inspection from September 5 through October 15, 1990, the following violation was identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, (Enfurcement Policy), the violation is listed below.

Plant technical specification 3.7.13, " Fire Rated Assemblies",

requires, in part, that all fire-related assemblies separating safety-related fire areas or separating portions of redundant systems important to safe shutdown within a fire area and all sealing devices in fire related assembly penetrations, (fire doors, fire windows).be operable.

The associated action statement of plant technical specification 3.7.13 requires that, if the fire-related assembly is inoperable, within one. hour, either a continuous fire watch be established on at least one side of the affected assembly or operability be verified of fire detectors on at least one side of the inoperable assembly and an hourly fire watch patrol be established.

Contrary to the above, on August 11, 1990, a primary equipment operator discovered a fire door biocked open without the compensatory fire watch established within the one-hour period specified by plant technical specification 3.7.13.

This is a Severity Level IV Violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to subrdt to this office, within 30 days of receipt of the letter which transmi+.ted this Notice, a written statement or explanation in reply, including:

(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and, (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
