LICENSED SENIOR OPERATOR REASSIGNMENT AND LICENSE TERMINATION

Dear Mr. Kreiger:

Your letter to the NRC, dated October 26, 1993, requested termination of a l

senior operator license due to a personnel transfer which had occurred on December 14, 1992. Your letter also stated that the notification was late due to an administrative error and that corrective actions have been taken to preclude re-occurrence.

Based on follow-up discussions by Mr. P. Morrill of the NRC and Mr. R.

Sandstrom of your staff, we understand that your corrective actions included (1) adding administrative controls to ensure proper notifications are made when licenses are terminated and (2) checking the need for all other operator licensees. We also understand that the subject senior operator's license was i

inactive at the time of his transfer and that he has not performed licensed duties since that time.

10 CFR 50.74 (a) specifically requires that the Commission be notified within thirty days of permanent reassignment of an operator to a position which no longer requires a license. The NRC was notified ten months after the reassignment, which is a violation of 10 CFR 50.74 (a).

Since (1) the failure to notify the NRC was identified by your staff, (2) the failure to notify has minor safety significance, and (3) this violation was not repetitive, the criteria of 10 CFR 2. App. C. VII. 8, Mitigation of Enforcement Sanctions, apply. Consequently the failure to notify the NRC within thirty days has been determined to be a non-cited level V violation.
