Dear Mr. DeLaBarre:
Enclosed is a letter from Transnuclear, Inc., dated November 29, 1993, which provides additional information regarding their pending application (XSNM02580) for the export of high-enriched uranium (HEU) to France for use as fuel in the HFR Grenoble research reactor. The original application, for 69.345 kilograms of uranium /64.699 kilograms of uranium-235, enriched to 93.3%, was forwarded to the Executive Branch en January 10, 1991 and Executive Branch views were completed on July 16, 1991; however, during the final review by the NRC it was learned that the Grenoble reactor would be shut down for an indefinite period of time. Action on the case was discontinued at that time, and we requested the applicant and the EURATOM office in Washington to keep us advised as to the anticipated start up of the reactor.
According to the attached updated reactor checklist, the quantity of material and enrichment remains unchanged. The date the material will be needed at the converter's facility is January 1995, and at the fabricator's facility by July 1995 for delivery to the reactor in July 1996.
Before taking action on the applicant's request to reinitiate review of the pending application, we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the proposed export meets the applicable criteria in the Atomic Er.ergy Act of 1954, as amended by the Nuclear Non-Proliferation act of 1978 and the Energy Policy Act of 1992.
