This is in reply to your letter of August 26, 1990, "Submittel of Topical Report (TR) DTI-WMS-100-NP/P." This letter also confirms the October 3'),1990, and November 1,1990, telephone confwences between you, Don Burroughs, Everett Wick and me regarding the TR nat Diversified Technologies (DTI) submitted. We have completed a preliminary review of the TR and have accepted it for review.

The TR has been assigned docket number WM-105.

Please ensure that all of your future correspondence pertaining to this TR is clearly marked with that docket number.

Our preliminary schedule for review of the TR is enclosed.

This schedule is based upon our issuing two requests for additional information.

If any of these requests are not necessary, the review period could be shortened accordingly. The schedule projects NRC issuance of its Technical Evaluation Report (TER) on April 30, 1990.

Issuance of the TER would allow Diversified Technologies to proceed with solidification of the waste form described in the TR although two more steps are required.

Please note that this schedule depends on current availability of )ersonnel, current projections of workloads, and the timeliness and t1oroughness of required vendor responses.

If any of these facts.> rhange, the schedule will also change.

Please note that our review will be limited to the test results of polymer solidification in large liners of dewatered resin beads using the Vinyl Ester Styrine In-situ (VERI) Process.

These test results are presented in Section 8 of the non-proprietary TR. We also will review related data in the Proprietary Appendices. The remainder of the 'R describes the Waste Processing System (WPS), the High Velocity Vacuum (HVV) dewatering system, and the VERI system and provides generic process control programs for the use of those systems.

This remainder of the TR, however, does not contain information needed by the NRC Office of Nuclear Material Safety and f6feguards u

I (NMSS) staff to reach conclusions regarding the capability of the waste forms to meet the structural stability requirements of 10 CFR Part 61.

During our telephone conference of October 30, 1990, you stated that Diversified Technologies, Inc., is anxious to obtain NRC approval of the entire topical report contents.

Since then, we have confirmed our i

understanding, related to you during the telephone conference, that the NRC Office of Nuclear Reactor Regulation (NRR), which is responsible for the

regulation of nuclear reactor operations involving radioactive waste

management systems, will accept for review vendor TR's describing these systems only if a potential operating license (OL) applicant has comitted to the topical report in its application or if an OL holder has requested NRC approval of a proposed modification to its plant, which references the topical report. NRR considers that OL holders normally may modify their plant radioactive waste management systems without prior approval of the NRC, under the provisions of Section 50.59 of 10 CFR Part 50.
