Dear Mr. Grant:
This is in response to your application dated January 30, 1984 for a license to export nuclear reactor components to the Rajasthan Atomic Power Station in-India.
l In accordance with our standard procedures, the Nuclear Regulatory Comission referred the export license application to the Executive Branch for their determination as to whether the requested export met the applicable' criteria of the Atomic Energy Act of 1954.as amended by the Nuclear Non-Proliferation Act of 1978.
The Department of State, as lead agency for the Executive Branch, informed the l
NRC that the necessary determinations for a recomendation of approval under the Atomic Energy Act, as amended, cannot be made, and has recommended that t
.the request for a license be denied.
t Under NRC Rules and Regulations (10 CFR 110.44(d)), the Commission will deny any export license application for which the Executive Branch judgment does 5
not recommend approval. Accordingly, your application for an export license is denied.

Dear Mr. Stoiber:
I refer to the letter from your ofIice dated February 17,1984, requesting the views of the Executive Branch as to whether issuance of an export license in accordance with the application hereinafter described meets the applicable criteria of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of1978:
NRC No. XCOM0862 -- Application by Bingham-Willamette Company for authorization to export to India spare parts for primary heat transport pumps, heavy water pumps and light water pumps in the Rajasthan Atomic Power Station.
The Executive Branch has reviewed the proposed export and concluded that the necessary determinations for a recommendation of approval under the Atomic Energy Act, as amended, cannot be made.
On the basis of the foregoing. the Executive Branch recommends that the request for a license be denied.
