NOTICE OF ENFORCEMENT DISCRETION FOR WISCONSIN ELECTRIC POWER COMPANY REGARDING THE POINT BEACH NUCLEAR PLANT UNITS 1 AND 2 By telephone call and followup letter on December 3,1993, you requested the U. S. Nuclear Regulatory Commission (NRC) to exercise its discretion not to enforce compliance with the required actions in Technical Specification 15.3.0.A.
You informed the NRC on December 2, 1993, at 11:05 p.m. that the Point Beach plant would not be able to comply with the emergency diesel generator (EDG) operability requirements within the 3-hour time limit.
Due to one EDG being out of service for planned maintenance and identification of the other EDG being out of service for a degraded starting system, you requested additional allowed outage time of 4-hours.
You provided as justification for continued operation that the emergency gas turbine generator (GO-5) was available to power both the Train A and Train B safeguards buses should a loss of offsite power occur, and that one EDG, while not declared operable, was available and expected to function as designed.
In addition the offsite grid
[CC7 was stable with all four offsite power sources available.
On the basis of our review of your justification and actions, the staff concluded that extending the allowed inoperability time involved minimal risk to public health and safety.
Integral to our decision was the increased safety attained by alleviating a shutdown transient on one or both units with both EDGs inoperable. Therefore, we exercised our discretion not to enforce compliance with Technical Specification 15.3.0.A for a period of four hours commencing at 1:56 a.m. on December 3, 1993. We understand that you returned' one EDG to service at 2:30 a.m. on December 3, 1993, thereby terminating any further need for this enforcement discretion. We will consider enforcement 1
