DISPOSITION OF DAARE/ SAFE CONTENTION 9c" On July 19, 1982, Intervenor filed with the Board an answerto staff's and Applicant's Motions for Summary Dispositign on the Pleadings.
Applicant's Motion did not oppose Intervenor's Contention 9(c), but on July 19, 1982, Applicant filed an " Answer to the NRC Staff's Motion for Summary Disposition of DAARE/ SAFE Contention 9(c),"

essentially supporting the motion except to the. extent the contention considers steam generator tube failure concurrent with other. design basis accidents.
10 C.F.R.8.749 (a) permits any party.to serve an 2
answer in support of a summary disposition motion, and further states, "The presiding officer shall permit the opposing party an opportunity to respond in writing to new facts and arguments presented in any supporting-statements which were not presented in the papers of the moving party" (emphasis supplied).
Since no time limits have yet been established within which Intervenor has been obliged to serve its response, Intervenor hereby moves for the admission of the attached r'esponse.
Such response addresses only the new facts and arguments' pre-sented, as limited by 10 C.F.R. 5 2 749 (a).
