Gentlemen:

I am writing to follow up briefly on one matter raised in connection with my presentation Thursday. After the hearing, I re-viewed the " Davis-Besse" case and confirmed that my understanding of that case was correct. " Davis-Besse," which is properly cited as Coalition for Safe Nuclear Power v. United States Atomic Energy Commission, 463 P.2d 954 (D.C. Cir. 1972), dealt with the appropriate-ness of allowing construction already underway to continue during the NEPA transition period in the early 1970's. It is no authority for proceeding today with a project whose construction has not yet begun.
