Dear Mr. Ross:
This is to acknowledge receipt of your letter of October 25, 1993 referencing Northeast Utilities' response to your 10 CFR 2.206 i
Petition.
Your comments and rebuttal of the Northeast Utilities' argument will be factored into our review of your Petition.
Your letter also requested that "this detailed rebuttal be kept confidential, and no information contained in this document be shared with Northeast Utilities" and that the " document be kept confidential to the full extent of the law."
With respect to your desire for coniidentiality, the 10 CFR 2.206 process is itself a public process and the fact that a 2.206 petition has been filed and the de cision with regard to that petition are not withheld from public disclosure.
In fact, as you are probably aware, we have alreac'y published a notice of receipt of your petition in the Egdgral Recister in accordance with the normal practice under 10 CFR 2.206.
Although it is possible that specific information considered during the 2.206 process that relates to personal privacy matters or confidential sources or which, for other reasons, should be protected in accordance with the applicable regulations will be withheld from public disclosure, this would be an exception to the normal public nature of the 2.206 process.
In accordance with the normal practice for the 2.206 process, we intend to address your petition in an open and public manner.
As for your request that the information contained in your letter not be shared with Northeast Utilities (NU), we will consider your request for withholding pursuant to the provisions of 10 CFR 2.790 and advise you as to whether withholding would be appropriate.
