In the Matter of the Clinch River Breeder Reactor Plant / Limited Site Preparation Work Authorization Permit I am writing this letter on behalf of the City Council of the City of Oak Ridge, Tennessee, in support of the Department of Energy's renewed request for a' limited site preparation work authorization permit in the matter of the Clinch River Breeder Reactor Plant. As you are well aware, the site for the Clinch River Breeder Reactor is located within our city. The Oak Ridge City Council has gone on record many times as supporting the construction of this facility on the Clinch River site. It has been our conviction that the breeder reactor project is vitally necessary in the future development of our Nation's energy technologies, and we continue to hold that conviction.

For this reason, the Oak Ridge City Council, sitting in regular session on January 4, 1982. voted to transmit to the Nuclear Regulatory Commission our statement of support for the Department of Energy's request to expedite the process for granting a limited site preparation work authorization per-l mit, thus enabling site preparation for the Clinch River Breeder Reactor l

Plant to proceed. It was at that time our position that the interests of the City of Oak Ridge will be adequately addressed during the regular Nuclear Regulatory Commission deliberations prior to issuance of construction and operation authorizations. We continue to hold that position.

I strongly feel that the Clinch River Breeder Reactor Project is vitally necessary in the future development of our nation's energy technologies.

I therefore strongly support the D.O.E. request for an early site preparation permit.

One of the greatest reasons for my feelings is that the United States is being economically choked by the unreasonable rise in oil. prices from the middle east. The United States must do everything possible to reduce this dependence and building CRBRP will help us use an already abundant supply of fuel for the generation of electrical power, thereby increasing the amount of oil available for our mobile energy needs.

od As an East Tennessean, I am writing about something of vital concern not only to my fellow Tennesseans, but also to all Americans:

the Clinch River Breeder Reactor Project.

Now that the Project has filed its third request to accelerate site preparation, I believe it is time to take any action necessary to complete the plant.

The reasons for my convictions are many, but I intend to list here only those of immediate importance:

o Probably the most important advantage is cost savings.

I understand that as much as $28 million can be saved annually if the Project is given permission to break ground soon.

Furthermore, approval oof the Project's request would preserve all elements of the NRC's environ-mental, satety, and hearings processes, and no action would be performed on the site that would not be redressable.

o Timely completion of the Project will ensure that this country's LMFBR technology will remain intact.

Without the Clinch River Plant as a demonstration facility, how can we prove the feasibility of breeder technology before we progress to the next step toward commercialization:

a scaled-up version of Clinch River?

The evolution of this country's fast breeder program follows essentially the same patterns as the evolution of its light cater program.

~

It would be foolish, both economically and technologically, to disrupt the path of breeder development at this point.

o Completing the Project now is in line with policies already established by the President, members of Congress, and the utility industry.

The President himself voiced his support for the Project as recently as May of this year, when he spoke at opening day ceremonies for the 1982 World's Fair in Knoxville.

Last November, at a board meeting of the Breeder Reactor Corporation, the utility industry reaffirmed its support by releasing $22 million for Project support.

And now, the old issues raised during the Carter years in attempts to cancel the Project are being revived.

Opponents continually introduce charges that the Project will increase risks of proliferation, that its timing is poor, and that its technology is antiquated, even though these issues have been successfully refuted on the record time and time again.

The expedient completion of the Clinch River Project is a sure path toward an abundant, economical supply of native electrical energy for centuries to come.

Dear Mr. Palladino:

We understand that the Department of Energy has requested permission from the Nuclear Regulatory Commission to accelerate site preparation activities for the Clinch River Breeder Reactor Project (CRBRP) by allowing non-safety-related site activities to proceed in parallel with environmental hearings.

Timely completion of the CRBRP is essential to the development of LMFBR technology in the United States and is consistent with President Reagan's nuclear policy statement.

We believe that LMFBR technology will be needed early in the next century to satisfy energy demands while improving fuel utilization thus extending our fuel rasources.

Therefore, Arkansas Power & Light Company supports the CRBRP and urges the Commission to approve the Department of Energy's request to l

Without compromising your safety and environmental review authority, your approval will:

1.

Save money by getting non-safety-related construction started now.

It is about time action was taken to control Clinch River's costs.

2.

Give a desperately needed signal that the United States can have more contribution from safe nuclear energy in its future.

There is no point in considering any more LWR commitments unless the breeder too is assured.

First, it must be demonstrated.

Department of Energy (DOE) exemption request under 10CFR50.12, regarding the Clinch River Breeder Reactor Plant, Docket #50-537

Dear Mr. Chilk:

I submit to the Commission the following comments on the DOE's request to the Commission to grant an exemption pursuant to 10CFR50.12 to conduct site preparation activities for the Clinch River Breeder Reactor (CRBR) prior to the issuance of a construction permit or limited work authorization. I also request the opportunity to make an oral presentation on this subject during the Commission's informal proceeding on July 29, 1982.

As I understand it, the question before the Commission is whether or not accelerated construction of the, CRBR will sufficiently serve the public interest to warrant exemption from a normal Commission refulatory requirement. My conviction is not only that it will not, but that the overall public interest would be much better served if the Commission denies the request.

The critical issues regarding. this request go far beyond the immediate and direct effects of accelerating the CRBR project.

In my view, these issues relate primarily to the risks of nuclear war or nuclear violence by terrorists or other criminals that are inherent in the widescale use of plutonium breeder reactors for

power production. I have searched for and not found thorough assessments of these risks, and of practical ways to deal with them, oy any institution now.. actively involved in the development of plutonium breeder reactors, or the planning for their widescale use.

My own ' assessments have led me to a conviction that sharp increases in the quantities of plutonium separated from spent fuel, and in the numbers of locations where large quantities of this plutonium exist, will greatly increase the risks of nuclear violence.

It is ironic that more and more people are burning wood in wood-burning stoves and fireplaces, in an attempt to conserve energy and, at the same time, preaching protec-tion of our environment, when wood-burning is apparently polluting our environment and, perhaps, contributing to acid rain.

Gcneration of electricity from hydroel~ectric and nuclear plants do not pollute the environment and provide l

a cheaper method of producing electricity.

Of course, hydroel>:. tric sources are limited, which leaves nuclear.

l The Liquid Metal Fast Breeder Reactor is a nuclear technology that can provide even more savings than a stand-l ard nuclear plant.

Several other countries are more ad-i vanced in this area than the United States.

We are supportive of the Clinch River Project and sincerely feel that its timely continuation will advance established national and utility industry policies.

More than a decade of Congressional support was reaffirmed in the Conference Report for the Omnibus Budget Reconciliation Act of 1981, and it is felt to proceed is in the best inter-est of the United States.

Although West Virginia has no nuclear power plants, we and other West Virginians support a healthy mix of energy sources including nuclear power now and for the future.

We will have to rely more and more on nuclear power as we continue to deplete our dwindling fossil fuel resources.

Breeder reactors offer the promise of an essentially inexhaustible energy source.

We have depleted uranium stored in cylinders at our enrichment plants that can, if used in breeders, provide the U.S.

electric energy needs for more than 700 years!

But to use this valuable resource, the U.S. must move forward in its liquid metal fast breeder reactor program.

An integral part of the program is completion of the Clinch River Plant.

The Clinch River Project has been delayed long enough by politics and by those groups who refuse to look objectively at the facts.

The technology is sound and the most advanced in the world; component order and fabrication is over 60% complete; design is over 85%

complete; research and development is over 95% complete; and all environmental considerations are being taken into account.

Thus, we urge you and the other Commissioners to vote positively on the Energy Department's request to begin site preparation for the Clinch River Plant.

I continue to read the newspaper accounts which are unfavorable toward the Project but I have yet to read an article which states any factual evidence as to why Clinch River should not be built.

The press has rather quoted persons who obviously are anti-nuclear and only use distorted hear-say or l

untrue information.

The country needs to explore all forms of energy and Clinch River must be on top of the list if this country is to remain the great country that we have been in the past.

The importance to this nation of the successful demonstration of the LMFBR Program cannot be over-emphasized, yet the Clinch River Breeder Reactor (CRBR) Project continually seems to become bogged down for various reasons.

Such has now become the case for the Department of Energy request to accelerate site preparation activities for the CRBR Project.

The Board of Trustees and management of this Cooperative have joined with the other cooperatives and municipal electric systems throughout the Tennessee Valley numerous times over the past several years to express support for the timely completion of the CRBR Project. Our national association, the National Rural Electric Cooperative Association (NRECA),

has urged completion of the Project in accordance with a formal resolution mandate of the more than 1,000 rural electric cooperative members. Yet, we still receive word the NRC is concerned that there may be a lack of

public support for the accelerated site preparation schedule. Why is this?

We support the CRBR Project and the request made for accelerated site preparation in accord with 10CFR50.12, which allows non-safety related site activities to proceed in parallel with environmental hearings. Our country needs a proven demonstration of breeder technology to begin to regain its leadership role in the international nuclear community and lessen our de-pendence upon foreign energy sources.
