Dear Mr. Lake:

SUBJECT:

Special Investigation No. 1-91-008 During 1991, the NRC's Office of Investigations conducted a special investigation which related to your activities relative to the purchase of two generally licensed devices from Exxon Chemical Corporation on March 11,1988. The investigation consisted of interviews with personnel of Exxon Chemical Company, Service Consultants and Converting Technologies, Inc.

The investigation revealed that, on March 11,1988, Service Consultants purchased from l

Exxon Chemical Company two Fife Sensor Model OSP-001 gauges each containing l

approximately 600 millicuries of krypton-85. At the time, this was identified as a possible violation of NRC requirements, i.e. the unauthorized receipt and possession of two generally licensed Fife gauges purchased from Exxon Chemical Corporation of Pottsville, Pennsylvania.

Upon further review of this matter, we have determined that neither Service Consultants nor Converting Technologies, Inc. was in violation of NRC regulatory requirements with respect to the receipt and possession of the subject gauges. The possession of these gauges was in compliance with NRC regulatory requirements under the general license provisions of i

10 CFR 31.5. In receiving the gauges, Service Consultants becomes a general licensee.

Please note that as a general licensee under 10 CFR 31.5 Service Consultants is responsible

l for complying with all of the provisions of the general license. Any future activities regarding the possession, use or redistribution of generally licensed gauges will be examined in light of those requirements.
