PROPOSED IMPOSITION OF CIVIL PENALTY - $112,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $112,500 will be issued on or about November 17, 1993 to the Commonwealth Edison Company.
This action is based on radiation protection violations that occurred during the disassembly of the Unit 2 reactor vessel head.
The violations resulted in a number of plant personnel receiving measurable intakes of radioactive material.
Collectively, the violations have been classiifed as a Severity Level III problem.
The base civil penalty of $50,000 has been escalated 125 percent after partially offsetting l
escalation for poor past performance and prior opportunities to identify with mitigation for identification of the self-disclosing event.
1 It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice November 17, 1993 Telephone hotification of Licensee November 17, 1993 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response,.the civil penalty may be remitted, mitigated, or imposed by Order.
