HIGHL1GHTS OF WEEKLY INFORMATION REPORT WEEK ENDING OCTOBER 26, 1990 Washington Nuclear' Project Units 1 and 3 A meeting was held on October 18, 1990 at the request of the Washington Public Power Supply System (the Supply System) to discuss the potential restart of licensing and hearing efforts on Washington Nuclear Project (WNP) Units 1 and/or 3.

The Supply System indicated that the WNP Units 1 and 3 were on the Northwest Power Planning Council's regional plan as potential power sources for scenarios of mid to high range power demands.

Based on these projections, the Northwest Power Planning Council requested the Bonneville Power Authority

and the Supply System to assess the actions that would be needed to reduce the uncertainties related to the subject WNP Units, including those involved in the licensing and hearing processes. This meeting was to establish a dialogue for further discussions to assess the actions needed and issues to be addressed to continue the licensing and hearing process. The Supply System emphasized that no decisions had bcen made concerning the future of the WNP Units 1 or 3 that the Supply System was just starting to scope out the resources that would be.needed to start the licensing and hearing processes again, and that the Supply. System had no plans to restart construction on the units at this time.

The staff indicated that a continuing dialogue should be established, and the next step was for the Supply System to outline issues and milestones to proceed with the effort.

Joint NRC/ DOE Training Initiative The Office of. Safeguards and Security, Department of Energy, has informed NRC, by letter dated October 11, 1990, of their enthusiastic support for an NRC proposal to develop joint physical security training for the two staffs.

-In the near future, the two offices will initiate development of a joint NRC/ DOE Physical Protection Technology Update to be conducted by Sandia National Laboratories. This effort, which is being coordinated with the NRC's Technical Training Center, should benefit both acencies by facilitating technology transfer to the agencies' staff in a cost effective manner.

Emergency Telecomunications System Upgrade A key component of the Nuclear Regulatory Comission's Emergency Telecomuni-

- cations System upgrade is the Statement of Work (50W) being developed by the Idaho National Engineering Laboratory, in an effort to produce the best possible 50W, NRC plans to release a copy of the proposed ETS specifications for industry coment prior to sending out the actual ETS contract solicitation.

In negotiating large, technical contracts, such an early review by industry is recomended to allow the government to take maximum advantage of industry expertise and ensure that requirements can be met at the lowest possible overall cost. The current schedule calls for this review to be conducted during. January 1991. Prior to the release of the actual $0W for solicitation of bids, NRC staff will brief the Comission, and provide an opportunity for the Comission to consider and comment on the 50W.

3 Office of Nuclear Reactor Regulation Items of Interest Week Ending October 26, 1990 Fermi-2 A Detroit Edison technical specialist was fatally ir ared abou? 5:30 p.m.,

Thursday, October 18, 1990, while performing balanciy and vibration monitoring tests on a reactor building ventilation supply fan.

The fan had been removed from service for repairs and was in a testing area of the turbine building on the non-nuclear side of the plant.

Te 36-inch fan was on a test stand at the time of the incident. The technician was taking vibration data, when she apparently fell into the operating fan.

It was de-energized immediately.

She was pronounced dead at the scene by a Monroe County medical examiner. The licensee is continuing to investigate the incident. Detroit Edison employees at Fermi-? had worked 1.8 million consecutive manhours without a lost-time injury or fatality, dating back to Noverr.ber 5,1989.

Palisades The Safety Injection Refueling Water Tank (SIRWT) has been drained and bottom vacuuming begins later this week.

Inspections of the tank will begin early next week to locate the source of leakage.

Similar problems with leakage in Vermont' Yankee, Yankee Rowe)perienced at several Region I sites (Haddam Ne aluminum SIRWTs have been ex Steam Generator Replacement Project (PALISADES)

The temporary containment access opening was completed last week.

Radiation levels on the liner plate ranged approximately 200 counts above backaround. A load test of the _ inner and outer gantry cranes was successfully completed on 10/23/90.

Removal of "B" steam generator was completed on 10/25/90. The "A" steam gene-

-rator is scheduled for removal on 10/27/90.

Rig-in of the new steam generators will follow, expecting to be complete by 11/2/90. This schedule is a week ahead 1

of the outage path and reflects time saved during refueling, scaffolding set-up, and gu:try trane erection.

Steam generator replacement project dose is 125 rem to date (approximately 50 rem below projected man-rem for this date).

Vogtle Units 1 and 2 On October 11. 1990, the licensee informed Region 11 that G. Bockhold had been transferred from his position as Plant Manager of Vogtle to a new position in Southern Services Company.

Bill Shipman, more recently the General Manager of Support Services in Birmingham, has been named as new Plant Manager on a temporary basis.

Waterford 3 On October 8, 1990,.with-the Waterford 3 plant shutdown for the repair of the.

-primary coolant system pressurizer code safety valves, the licensee discovered boric acid crystals around the #2A (Byron Jackson) reactor coolant pump (RCP) flange between the pump casing and the driver mount.

The presence of boric acid. crystals was indicative of coolant leakage past the two concentric flexitalic gaskets installed between the flange and the pump casing.

There l

was no evidence of< any external leakage on the other three RCPs.

It was determined that the. studs on #2A RCP should be examined for corrosion in order to evaluate the operability of the reactor coolant pump before restarting the reactor.

Due to time and exposure considerations, and the potential for galling, the licensee decided not to remove and visually inspect any studs, but instead utilized two ultrasonic testing (UT) methodologies to examine all 16 studs in place. The two techniques, angle ) robe and cylindrical wave both reflected no evidence of stud wastage and t1e licensee determined that the pump was operable, t

he licensee determined that it could start up the reactor and continue to run j

saAly with the known RCP leakage until the next scheduled refueling outage beginning in March 1991. This was based on the results of the inspection of the studs, the routing of the known leakage to the reactor drain tank, a consnitment to perform enhanced mcnitoring of two RCPs, and the commitment to inspect the RCPs in the event of increased pump leakage beyond acceptable limits (remote video cameras, visual, and UT as appropriate).

The staff requested that the licensee perform an engineering evaluation to consider the failure of up to 6 adjacent studs in the pump assembly. The L.

leakege may have af fected 5 or 6 of the 16 studs on the pump.

3-Region IV issued a Confirmatory) Action Letter (CAL) indicating that Waterford 3 would not enter Mode 2 until: 1 NRC completed satisfactory inspections of the UT techniques and results, 2) the review of the proposed leakage monitoring techniques was conducted by NRC staff, and 3) a conference call was held between NRC and the licensee to discuss the results of the engineering analysis (bounding failure analysis for RCP stud degradation).

Based on the inspection findings and the preliminary results of the licensee's analysis, the Headquarters and Regional staffs determined that the requirements of the CAL'had been met and approved the restart of the reactor.

As of October 16, the plant was in Mode 1, at 100% power.

The licensee is considering options for corrective actions during the 1991 refueling outage. The resident inspector will continue to monitor the RCP status.

Drug Testing Problems for Methamphetamine The staff has been informed by the National Institute on Drug Abuse (NIDA) that a NIDA-certified drug testing laboratory incorrectly identified the presence of methamphetamine in five urine drug tests when an over-the-counter drug may have been involved.

NIDA has taken steps to determine whether the problem involves how the confirmatory method was used by the laboratory or is the.

result of a problem with the method itself. The latter case may affect other laboratories using the same testing methods.

NIDA has issued a press release and has notified all of the 57 NIDA-certified laboratories, who do testing for Federal agencies and Federally-regulated industries, including NRC licensees, of possible problems with this particular testing method and directed those using'that method to use an alternative procedure when confirming the presence of methamphetamine in urine.

In addition NIDA has taken the following actions:

conducted an onsite inspection of the laboratory, performed a retrospective review of reported results of urine tests and analytical data from that laboratory, and initiated similar procedures for seven other NIDA-certified laboratories determined i

to be using the same method, 1

1 directed the laboratory to report the reanalyzed test results to the L

Medical Review Officers who will contact the affected employers, and g

L for laboratories using the method in question, initiated independent L

retesting source which were previously reported positive for

methamphetamine.

This problem potentially involves about 30 drug tests conducted by NRC licensed facilities. The staff is working with NIDA to assure that the testing problem

.is resolved and that appropriate corrective actions are taken if inaccurate test results are found to have occurred for NRC licensees.

GuideTubeSupportPinsCrackingatRobinson(EMCB)

An ultrasonic examination of the guide tube support pins in the Robinson Nuclear Unit 2 Plant was performed during the current outage to determine if indications of support ein cracking exist.

The ultrasonic examination results suggest that several pins have indications of cracking. Carolina Power and Light Company has decided to. replace the cracked pins with new pins which incorporate an improved pin design and a high temperature (2,000 F) material heat treatment.

Control rod guide tube support pin cracking involving plants designed by Westinghouse have been previously experienced in Europe and at the-Haddam Neck Nuclear Plant.

The NRC staff considers the support pin cracking problem to be potentie11y generic and has' scheduled a meeting with the licensee to discuss in detail

.the:petential generic implications of the issue.

Pilgrim EP Fact-Findina Task Force The field teams have been formed, each including an NRR team leader, a regional EP inspector, and a FEMA representative.

The teams are coordinating their offsite EP fact finding in the Pilgrim area through FEMA, State and local officials.

Field work is expected to start around the end of October.

Safeguards Exercise

On October 23, 1990, a " Tabletop" exercise was held at the NRC Incident Response Center, Maryland National Bank Building. Members of the Fuel Cycle Safeguards Team, Division of Safeguards and Transportation, participated and the Office for

- Analysis and Evaluation of Operational Data staff served as moderator.

International Atomic Energy Agency (IAEA) Inspection at the B&W Facility On'0ctober 18, 1990, an IAEA team conducted an announced ins)ection at the B&W Fuel Company in Lynchburg, Virginia.

The team audited tie low enriched uranium facility's ledger, verified the uranium dioxide pellet receipts, weighed and sampled uranium dioxide pellet boxes and measured other pellet boxes by nondestructive assay.

Plutonium Air-Shipment Mr. G. Arlotto, Deputy Director, Office of Nuclear Material Safety and Safeguards and members of.the Transportation Branch staff. met with the Power Reactor and Nuclear Fuel Development Corporation (PNC) of Japan in Tokyo on October 18-19, 1990, to' discuss the final report " Draft Criteria for Controlled Tests for Air Transport Packages." The report describes technical criteria to satisfy Section 5062 of Public Law 100-203 (Murkowski Amendment), and'was previously provided to PNC with a number of detailed technical reports.

The reports were prepared by Lawrence Livermore National Laboratory (LLNL) under NRC contract. The LLNL staff also participated in the discussions.

In the meeting, NRC and LLNL provided details on supporting analyses for the controlled test criteria, and responded to PNC questions on the reports. A study to explore methods for meeting the controlled. test criteria is to be conducted.

High-Level Waste Quality Assurance (QA) Workshop The U.S. Department of Energy (DOE) held a QA workshop at Las Vegas, Nevada, October 10-12, 1990.

Participating'in the workshop were the QA personnel from the DOE National Laboratories and U.S. Geological Survey which support the Yucca. Mountain Project. The Division of High-Level Waste Management On-Site o

l Representatives also attended the workshop as observers.

' t The workshop was successful in that major issues were identified and recom-mended solutions were proposed. The major recommendations will probably be keyed to: a) simplifying the complex hierarchy of requirement documents imposed on the DOE participants; b) involving scientists in the preparation and con-currence of implementing procedures; and c) initiating a seminar to explain to the DOE participants the licensing process and need for QA regulatory require-nents for scientific and research activities.

Nuclear Energy Agency, Radioactive Waste Management Committee Collective Opinion On October 9, 1990, the Division of High-Level Waste Management staff was in-formed that the Radioactive Waste Management Committee of the Nuclear Energy Agency has approved publication of a " collective opinion" regarding safety assessments for high-level radioactive waste repositories.

The collective

. opinion will express the committee's confidence that assessments of long-term repository performance are technically feasible, and that such assessments can provide the technical basis for evaluating the acceptability of specific re-positories.

Publication and dissemination of the collective opinion is expected later this year.

Request for Technical Assistance By letter dated August 22, 1990, the State of Tennessee submitted an update to a technical assistance request to the NRC, re i

Recycle Center (located in Oak Ridge, Tennessee) questing review of the Quadrex and their use of the IMPACTS-BRC (Version 2.0) Code. The Quadrex Recycle Center removes radioactive contami-nates from metals and other materials with surface contamination to permit reuse of those materials. Quadrex has requested extension of the surface re-lease contamination criteria to bulk materials where radioactive contamination may be dispersed throughout the material.

Mixed' Waste Guidance On September 28, 1990, the Environmental Protection Agency issued guidance on the Resource Conservation Recovery Act (RCRA) land disposal restrictions to be sent to all Nuclear Regulatory Commission (HRC) licensees.

This guidance is intended to provide a general overview of the RCRA land disposal restriction regulations as they apply to mixed wastes. While the document had not been coordinated with Division of Low-Level Waste Management (LLWM) staff, LLWM is currently reviewing the guidance to ensure that we have no major concerns before we transmit it to our licensees and Agreement State licensees.

Office of Nuclear Regulatory Research Items of Interest Week Ending October 26, 1990 18th Water Reactor Safety Meeting The. Annual 18th Water Reactor Safety Meeting, sponsored by the Office of Nuc-lear Regulatory Research, was held at the Holiday Inn Crowne Fiaza, Rockville, Maryland, on October 22-24, 1990. The meeting was attended by over 540 repre-sentatives of government, industry, universities, and public interest research groups, of which 14T were from 22 foreign countries, and approximately 125 were

.from the NRC. The three-day meeting included 18 sessions on: Severe Accident Research, Pressure Vessel Integrity, Radiation Protection, Piping & NDE, Con-tainment Testing & Structural Engineering, Aging & Components, Individual Plant Examination, Human Factors Research,' Organizational Factors & Reliability 4

Assessment, Waste Management Research, Earth Sciences, Accident Management, Probabilistic Risk Assessment, Seismic Engineering, and Thermal Hydraulics.

Eric S. Beckjord, Director, Office of Nuclear Regulatory Research, was one of the three Plenary Session speakers, which also included Commissioner Kenneth C. Rogers and Dr. Herbert J. C. Kouts of the Defense Nuclear Facilities Safety Board.

The Interagency Committee on Metric Policy

.Dr. Sher Bahadur represented NRC at the meeting of the Interagency Committee on Metric Policy (ICMP) held in Washington, DC on October 24, 1990, to discuss the status of metrication activities in Federal agencies. The meeting was attended by' the representatives from twenty three agencies and chaired by Dr. Robert White, Under Secretary for Technology at the Department of Commerce.

has prepared an Executive Order on Metric Usage for President Bush's signature, The draft was approved in the meeting with an understanding that the Executive Order will be sent to all agencies for concurrence after the OMB review is completed which is currently under progress. Dr. Bahadur reported the status of metrication activities at NRC including (i) the workshop on metrication held last year; (ii) the recently completed NUREG that includes relevant information on metrication; and (iii) the Commission's policy statement on metrication L

W. E. Campbell, RES 492-3806 Severe Accident Management On October 18-19,.1990, NRC staff attended the third meeting of CSNI's Task GrouponContainmentAspectsofSevereAccidentManagement-(CAM)thatwas held in Toronto, Canada.

The main objective of the meeting was_to discuss the following draft papers that were proposed for the full CSNI's consideration for' publication:

1.

Inadequate Isolation of Containment Openings and Penetrations.

2.

Positive / Negative Aspects of Measures Designed to Protect the Containment.

3.

Hydrogen Management Techniques in Containment.

4.

Instrumentation for Severe Accident Management in Containment.

I The CAM group agreed to recommend all exce)t the second paper to the CSNI to be considered in the committee's meeting tlat is scheduled for November 1990.

'The second paper attempted to assess the positive and the negative aspects of containment accident management measures such as: filtered venting, flooding reactor cavity, combustible gas control, etc. There are large phenomenological

..L uncertainties in most of these measures. The group is uncertain whether a useful report can be assembled in the next couple of weeks'. Presentation of this paper to the full committee is likely to be delayed until next year.

3 Germany proposed, and the CAM group agreed, that a specialist meeting on Instrumentation Needed to Manage a Severe Accident be held in 1992. Mr. J.

Rohde of Germany will prepare the agenda of subjects to be discussed iii the meeting. The exact time and place of the meeting will be determined later.

The next CAM meeting is scheduled on May 21 and 22, 1991, to be held at the OECD headquarters in Paris, France.

Office for Analysis and Evaluation of Operational Data 1

Items of Interest Week Ending October 26, 1990 Diagnostic Evaluations The Oyster Creek DET will begin its initial two-week onsite evaluation on November 5, 1990. The entrance meeting will be held at 1:30 p.m.

The DET is scheduled to conduct a follow-up one-week onsite evaluation beginning on December 3, 1990.

Incident Response On October 22-26, 1990, AE0D conducted the. Dose Projection Workshop in Bethesda,- Ma ryland. The Workshop included presentation by the scientific experts whose work was the' source of our projection and the programmer who developed the RASCAL code and many hands-on problem sessions. The Workshop was attended by region and headquarters response personnel who perform the dose assessor function during emergency response exercises and actual events.

On October 23, 1990, IRB staff conducted a Tabletop Safeguards exercise with the full team of NMSS Safeguards staff.

Issues discussed included early response communications and coordination with the FBI.

Technical Training Center The TTC staff has completed a major project which adds input /out (1/0) override 1

. capability to the BWR simulator located at the TTC. This I/O override capability has been added to the reactor control panel and reactor core cooling benchboards. This capability allows control switches, meters', controllers,

.and recorders to be individually controlled by the instructors independent of the' simulator modeling. This capability will allow increasingly complex scenarios during.certain simulator courses. This project was completed over a t

number of months and is part of an overall super-project associated with upgrading.the capabilities of all full scope reactor simulator located at the TTC.

by State emergency management officials, provided an opportunity for these State officials to identify common interests; exchange information on State and local REP planning approaches; discuss ways of increasing States' impact on evolving Federal REP guidance; and improve communication on all REP-related issues.

Waterford-3 Emergency Planning Exercise h

Charles Hackney, Region IV State Liaison Officer, participated in an emergency planning exercise at the Waterford-3 Generating Station on October 23-25, 1990 in Taft, Louisiana.

Mr. Hackney participated as a member of the Regional Assistance Committee which evaluated the exercise.

The exercise included State and local government participation.

i Farley Emergency Planning Exercise Robert Trojanowski, Region 11 State Liaison Officer, participated in an emergency planning exercise at the Joseph M. Farley Nuclear Plant on October 24, 1990 in Dothan, Alabama. Mr. Trojanowski participated as a State liaison at the State forward emergency operations center which is co-located at the Houston County Emergency Management Agency.

Briefing of North Carolina Legislators on BRC Robert Trojanowski, Region 11 State Liaison Officer, briefed a select group of legislators from North Carolina on the Commission's BRC Policy Statement on October 26, 1990 in Raleigh, North Carolina.

International Visitors On Monday, Tuesday and Wednesday, Mr. Fernando Robledo, an inspector with the Spanish Nuclear Safety Council (the CSN) met with staff from RES and NRR to discuss containment venting, leakage testing and accident management.

Karwat,' Munich University'of Technology, Germany met with staff from RES to discuss hydrogen management. Mr. Vayssier also received a demonstration of NRC's NUDOCs system.

On Wednesday Dr. Borut Mavko, Director of the Department of Reactor Engineering i

at the Jozef Stefan Institute in Yugoslavia met with NRR staff to discuss steam generators and with GPA/IP staff to discuss cooperation with the NRC. He also received a demonstration of NRC's NUDOCs system.

Emergency Telecommunications System Upgrade A key component of the Nuclear Regulatory Commission's Emergency Telecommuni-cations System upgrade is the Statement.of Work (50W) being developed by the

- Idaho National-Engineering Laboratory.

In an effort to produce the best~

possible 50W, NRC plans to release a copy of the proposed ETS specifications for industry comment prior to sending out the actual ETS contract solicitation.

In negotiating large, technical contracts, such an early review by industry is recommended to allow the government to take maximum advantage of industry expertise and ensure that requirements can be met at the lowest possible overall cost. The current schedule calls for this review to be conducted dur.ing January 1991.

Prior to the rele:se of the actual S0W for solicitation of bids, NRC staff will brief the Commission, and provide an opportunity for the' Commission to consider and comment on the S0W.

A Notice of Violation and Proposed Imposition of-Civil Penalty in the amount of $5,000 was issued on October 22, 1990 to Tripler Army Medical Center, Hawaii. The action was based on failure to comply with a procedure requiring licensee personnel to ensure, prior to the administration of radioactive substances,.that the patient is not breast feeding an infant.

.This failure led to an incident in which a patient breast fed her three.

week old infant after receiv.ing a dose of. iodine-131.

The staff submitted this action for Commission review in SECY 90-333 and the staff was directed to issue the action via'SRM dated October 19, 1990.

A Notice of Violation and Proposed imposition of Civil Penalty in the amount of $75,000 was issued on October 24, 1990 to GPU Nuclear Corporation.

The action was based on the failure of the licensee to properly implement its licensed l operator requalification program.- Inadequate examination grading' practices resulted in the issuance of passing grades to two licensed individuals who failed their biennial requalification written-examination administered by the licensee. The civil penalty was escalated 50% because the NRC identified the violation.

Civil Penalty Paid Tennessee Valley Authority (Watts Bar) paid the civil penalty in the amount of

$240,000. The action was based'on a violation involving harassment of NSRS' employees as.a consequence of their raising safety concerns.

Enforcement Conferences involving-Fitnes,c for Duty Issues Enforcement Conferences were held on October 18 with Maine Yankee'(MY)' and on October 22 with Haddam Neck and Millstone Point (both operated by-Northeast Nuclear Energy Company) to discuss fitness for ' duty (FFD) issues.

The issues discussed'were reviewed during the initial inspections of the respective licensees' FFD programs, which were required to be implemented effective January 3,1990.

Indian Point 3 - Inadvertent Liftoof Two Fuel Assemblies.

The fuel assemblies inadvertently lifted on October 4,1990 were recovered 1

in specially-constructed baskets by October 17,'1990.: The elements were then removed from the catch baskets and moved into_the spent fuel pool on

-October 19, 1990. _This completed the recovery phase of the event.. An

' Augmented Inspection Team composed of staff members from Region I and the

' Office.of Nuclear Reactor Regulation began an inspection of the event.in order to examine issues directly related to the event and its causes.- The.

team began its onsite work on October 24, 1990. The team will evaluate the.

sequence of events leading to the inadvertent lift, the extent of the event' 1

and~its root cause(s), and the licensee analysis and generic aspects, f

personnel, and information' flow between response facilities.

South Carolina Electric and Gas Company - Summer On October 25, South Carolina Electric and Gas announced the appointment of Bruce D. Kenyon as President and CEO. Mr. Kenyon's appointment is -

effective November 12, 1990. He succeeds Thomas C.-Nichols who is re-1 tiring October 31, 1990.

Mr. Kenyon was a Senior Vice President of Pennsylvania Power and Light Company, 4.-

Entergy Operations Inc. - Grand Gulf On October 24, the licensee reported that while conducting refueling operations the hoistLlowering brake malfunctioned and allowed a fuel

-bundle to.rachet into the core. There was no apparent damags to the subject or adjacent bundles. The licensee stopped all refueling opera-tions and is' conducting an investigation'of the equipment malfunction.

Duane Arnold Energy Center On October 19, 1990, Duane Arnold had a complicated scram. The plant was operating in single loop when a maintenance worker inadvertently pulled a potential transformer which senses the supply voltage from the startup j

transformer to nonessential and essential buses. The subsequent slow 1

4 transfer of the essential bus from the startup to-the standby transformer resulted in the loss of feedwater flow to the reactor and eventually a low reactor water level scram.

Reactor vessel water level was subsequently restored using reactor core isolation cooling..

Due to unexpected complications following the slow transfer of the essential. bus from the startup to standby transformer; power was lost to some plant. communication equipment and the drive motors associated with the intermediate and startup range monitors for about 15 minutes.

Because of this the plant declared an Unusual Event.' Also, since during this time the plant could not confirm the position of three control rods, due to rod over-travel'and 'the temporary loss of the computer used-to verify rod

. position, the' Emergency Operating Procedure-for an Anticipated Transient Withoutl Scram was entered.

The residents and Region III management followed. licensee' actions.and j

discussed the results of'their post scram review prior to plant restart on October 21, 1990.

Several long term licensee actions are planned to assure similar events do not recur.

resulted in several reactor trips at CPSES, Unit 1.

Meeting with Homestake Mining Company The Regional Manager, Environmental Affairs, and the Plant-Manager for the Homestake Mining Company's Milan Uranium Mill met with the Director, Uranium Recovery Field Office and selected staff on October 19, 1990.

The licensee provided a status report on completion of evaporation ponds for j

' disposal of cos,taminated groundwater, and advised that due to recent heavy-rains, and a contract dispute, that the date of completion would slip from November 1 to November 15, 1990.

He committed to' continue operation of an ion-exchange system to remove hazardous constituents from recovered ground water pending completion of the evaporation pond. The_ Milan Mill,' located' s

near Grants, NM, is permanently shutdown, and is preparing for site reclamation.

Comissioner Rogers to Visit Cooper Nuclear Station On Tuesday, October 23, 1990, NRC Commissioner Dr. Kenneth C. Rogers and the Region IV Regional Administrator visited the Cooper Nuclear Station.

The Commissioner is expected to tour the facility and interview selected members of the licensee management.

URF0 Meeting with Petrotomics The-Uranium Mill Supervisor of Petrotomics has requested a meeting _with the Director and selected staff of the Uranium Recovery Field Office, Region IV, to discuss the ground-water corrective action plan for their Shirley Basin uranium mill in Wyoming. They wish to discuss criteria for application of alternate concentration limits as goals in their corrective action plans.

The amended agreement would empower. Illinois to regulate uranium and thorium-mill tailings under the Uranium Mill Tailings Radiation Control Act.

The order denies'both the request for oral argument on the proposed amendment to the commission's agreement with Illinois, E

and the motion that.a formal adjudication on Illinois'-

differing 11e(2) standards be held before the Commission decides whether to amend the agreement with Illinois.

The order also indicated that the Commiss2on had approved.the amendment to the Illinois agreement.

In doing so the Commission approved the Illinois aeneric program for regulation of 11e(2): byproduct material.

However, the' Commission also determined that-it has a site-specific obligation that will arise only later if and when Illinois, having acquired authority over. byproduct material, seeks-to impose standards

_ which= differ from the Commission's-own standards.

If the State seeks to adopt alternatives to any requirements adopted and

. enforced by the Commission for disposal ~of the materials at the West Chicago' site, the Commission will determine, after notice and. opportunity for a hearing, whether the State's alternative will achieve a' level of stabilization and containment at the West Chicago site, and a level of protection for public health, safety and the environment from both radiological and nonradiological hazards'which are equivalent to, to the extent 4

practicable, or more stringent than, the level which would be achieved by any requirements adopted and enforced by the Commission for disposal of the materials at the West Chicago site.
