20555 Dear Mr. Chairman I am writing with regard to Subcommittee Chairman Kostmayer's September 14 letter inviting the Commission to testify at a hearing to be conducted in Plymouth, Massachusetts on October 22.

I have received a copy of your October 2 response to Chairman Kostmayor.

I am in sympathy with the Commission's concerns that to testify at this hearing would establish a precedent and that to participate in this and other field hearings would be disruptive of the Commission's operations.

Notwithstanding such concerns, however, I believe that the unusual circumstances of the Pilgrim situation warrant the Commission's appearance in Plymouth on October 22.

l Many people in the area surrounding the Pilgrim Nuclear Power Plant believe the Commission authorized the plant to operate on the basis l

of falso information provided by NRC staff.

These people believe l

that the Pilgrim emergency plan is inadequate and that there is insufficient assurance that the public safety would be protected j

in the event of a severe accident.

The Commission itself appears to have admitted that its Pilgrim restart decision was based on inaccurate information provided by NRC staff and that the emergency plan may be inadequate.

In light of this, I believe the people in the Plymouth area deserve an explanation of the basis for the Commission allowing Pilgrim to continue to operate.

It is entirely appropriate that this l

accounting take place in the area where the affected people reside.

Under normal circumstances, the appearance of NRC staff would suffice; but here, it is an unfortunate fact that the citizens of Southeastern Massachusetts have real reasons for not believing staff testimony.

It is important, therefore, that the Commissioners themselves testify on the Pilgrim situation.
