Dear Mr. Dickherber:
I would like to thank you for attending the Enforcement Conference held in the NRC's Region III office on July 13, 1990, to, discuss your role in the October 17, 1989 fuel movement errors at the-Quad-Cities Power Station.
In particular, we discussed the citTumstances surrounding your direction to subordinates that a misplaced fuel assembly was to be moved without revising the fuel transfer sheet.
Further, you took this action after being reminded of the need to process such a revision.
The amplifying i
information you provided was helpful in determining the disposition of this matter.
4 NRC reactor operator licensees carry with them a public trust to protect health and safety.
As I indicated during our mee'ing, i
proper compliance with established procedures is essentital to accomplishing this goal.
Further, the standards and examples set by senior-licensed operators are vital for individuals under their direction to perform in a professional manner.
I believe
' hat you now have a better appreciation for the high level of personal accountability and performance'the NRC requires of all licensed' individuals.
l As you are already aware, we have determined that the best course L
of action in this matter is to modify the Order issued on February 23, 1990, to the Commonwealth Edison Company modifying
'the. Operating License for the Quad' Cities Nuclear Power Station
.and also to maintain the present suspension of the limited Senior Reactor Operator license issued to you..EThese actions will allow syou to participate in the rehabilitation program, as described in the July-11, 1990 letter submitted'to the Nuclear Regulatory Commission by the Commonwealth Edison Company.
The NRC may-reconsider removing the suspension of the license issued to you upon your successful completion of the rehabilitation program.

OF ENFORCEMENT CONFERCECE WITH MR.
R.
L.
DICKHERBER On July 13, 1990, an Enforcement Conference was held between the NRC's Region III office and Mr. R.
L.
Dickherber to discuss Mr.;Dickherber's actions pertaining to the October 17, 1989, fuel movement errors made at the Quad Cities Nuclear Power Station.
Commonwealth Edison Company was also in attendance as an Order had been issued against the operating license for the Quad Cities
' facility.

_ Company The" meeting was opened with an overview of the enforcement conference purpose,-a summary of the-fuel movement-issue, and a statement =of the NRC's expectations relative to a Senior Reactor Operator's performance of his position's responsibilities.
~Neither Mr. Dickherber nor.the Commonwealth' Edison Company disputed any of the facts presented.by the NRC, although'Mr.
Dickherber did clarify the facts of communications with the i
control room during-the event.
A detailed review of the specific event and the details of the proposed violation were then provided to Mr. Dickherber.
t Mr.'Dickherber described the event from his perspective.
He'also addressed his thoughts on why the Commission should not revoke his license..After'his statement, Mr.'Dickherber was asked a number of questions dealing with the event of October 17, 1989, and his thoughts regarding the reason (s) for his actions.
Mr.
Dickherber answered those questions, as well as questions which focused on his current activities at the Quad Cities Station.

- The -information provided by Mr. Dickherber did not alter the facts as understood by the NRC or mitigate the significance of the event.

4 Mr. Lefstein discussed the issues dealing with inaccurate j
statements made in Mr. Dickherber's initial written response to the Commission's Order suspending Mr..Dickherber's license.
Mr.
D. Galle provided.a briefing on the remediation plan j
commonwealth Edison Company had developed in cooperation with Mr. Dickherber,'to return Mr. Dickherber to activities licensed l-under 10-CFR Part 50 at the plant.
The plan, which had been submitted to the-NRC in a letter from Mr. Galle to Mr. Davis dated' July 11, 1990,-would require the NRC to conditionally lift the order. issued ~against the-Quad Cities operating License.
The plan did not'_ address returning Mr. Dickherber to duties licensed under 10!CFR Part 55.
Mr. Galle also provided an overview of Mr. Dickherber's performance over the past 25 years as a Commonwealth Edison Company = employee. This i: orma,. ion also had been provided to the L

None'of>Mr..Galle's comments provided additional information to that already known by the NRC.
Mr.: Davis closed the meeting with a short discussion of the l'
suspension of the license issued to Mr.-Dickherber and advised Mr. Dickherber and Commonwealth Edison Company that the NRC would
