any nuclear facilities under 'ts. jurisdiction which would be capable and willing to store spent fuel until the Department of Energy-(D0E) takes-possession.

can comply with a Maine statute regt gnt nuclear fuel storage, the effective date of which is now approaching, in this regard, vould like to ask your help in determining whether the Nuclear Regulatory Commission (K <, may have the means to assist us. Let me provide some background in explanation of this remst.
Maine Yankee Atomic Power Company is a single-asset corporation which owns and j!
operates an 850 megawatt nuclear power plant located in Wiscasset, Maine. The Maine Yankee plant began commercial operations in 1972 and its current operating license will expire in 2008.
While the Maine Yankee plant has posted superior performance, economic and safety records, it has been subjected to three statewide referendum votes in the past decade, each aimed at shutting it down. In addition, the Maine Legislature has traditionally taken an activist approach to nuclear issues. In 1982, the Legislature enacted P.L.1981, c. 643, "An Act Concerning the On-Site Storage of Spent Nuc! car Fuel," a copy of which is attached.- This law prohibits storage at the Maine Yankee plant site of spent fuel (high level nuclear waste) after July 1,1992 ifit was removed from the reactor more than three years previously. The amount of affected spent fuel-
' will consist of approximately 937 fuel assembPs (and approximately 72 more assemblies each eighteen ' months thereafter) at the time this law becomes effective.
- Because the effective date of this measure is approaching and the matter is likely to >
become a publicly debated issue soon, we are now investigating our options for dealing with it.
As a first step, we are seeking to determine whether any means are available which would enable us to comply. This~would mean transporting the affected spent fuel from the Maine Yankee plant site to some other facility capable of and willing to store the spent fuel until DOE takes possession.

In this regard, we would like to request that the NRC undertake to identify any nuclear facilities under its jurisdiction which would be able to provide such a service to us. We would undertake to make contact and pursue the matter ourselves from that point forward with any facilities identified.
We are attempting to complete our analysis of compliance options no later than October 31" of this year and will be extremely appreciative of a response from the' NRC prior to that date, if at all possible.. We are also contacting the Department of Energy and other U.S.
commercial nuclear plants with similar requests.
