NRC STAFF'S RESPONSE TO APPEAL BOARD ORDER OF JUNE 29, 1982 1.

INTRODUCTION AND BACKGROUND In an Order issued June 29, 1982, the Atomic Safety and Licensing Appeal Board (Appeal Board) in the captioned proceeding requested certain additional infomation from the NRC Staff concerning the NRC's incident response planning. Specifically, the Appeal Board directed:

(1) that the Staff provide to the Appeal Board and parties actively participating in this proceeding, copies of:

(a) NUREG-0845, Agency Procedures for the NRC Incident Response Plan; (b) the Regional Incident Response Supplement (with an explanation as to the status of lists of emergency response equipment which were missing from a copy of the Regional Incident Response Supplement provided earlier to the Appeal Board);1/

2-(c) the TMI Program Office Supplement, the sii.e specific subpart to the Regional Incident Response Supplement (with an explanation as to the status of site-specific maps, site plans and transportation procedures which were missing from a copy of the TMI Program Office Supplement provided earlier to the Appeal Board);2_/ and (d) the NRC Headquarters Incident Response Supplement; and (2) that the Staff supply, in affidavit form, current infomation with regard to 16 listed areas of Appeal Board concerns on NRC incident response planning.

Pursuant to the Staff's motion for an extension of time _/ the Staff's response is due July 23, 1982. That 3

response is as set forth below.

II. NRC STAFF'S RESPONSE 1.

NRC Incident Response Procedure Documents In response to the Appeal Board's directive, copies of NUREG-0845, Agency Procedures for the NRC Incident Response Plan, were forwarded to the Appeal Board and parties to the proceeding by letter from Staff l

counsel dated July 8, 1982.

Information on the current status and use of NUREG-0845, which is designated as being "for interim use and comment,"

is provided in the attached affidavit of Joseph E. Himes. Copies of the 2/

\\ NRC Region I Incident Response Supplement (with emergency response equipment lists and an explanation of the status of incomplete parts of that document), of the TMI Program Office Supplement (with site-specific maps, site plans and transportation procedures), and of the NRC Headqiarters Incident Response Supplment were forwarded to the Appeal Boarr and parties to the proceeding by letter from Staff counsel dated July 13, 1982.

Current Information on NRC Incident Response Planning In response to the Appeal Board's directive, current information on each of the 16 areas of concern regarding NRC incident response planning is set forth in the attached affidavits of Joseph E. Himes and Charles

0. Gallina. Mr. Himes' affidavit is directed to NRC incident response planning with regard to NRC Headquarters whereas Mr. Gallina's affidavit focuses on NRC regional and site-specific incident response planning.
