REQUEST FOR WITHHOLDING WCAP-13522, "VIRGll C. SUMMER STEAM GENERATOR INTERIM TUBE PLUGGING CRITERIA FOR INDICATIONS AT THE TUBE SUPPORT PLATES," FROM PUBLIC DISCLOSURE (TAC NO. 85792)
By your application dated January 27, 1993, accompanied by Peter Morris' affidavit dated January 28, 1993, Westir.ghouse submitted WCAP-13522, " Virgil C. Summer Steam Generator Alternate Tube Plugging Criteria for Indications at the Tube Support Plates." Westinghouse also asked that this WCAP be withheld from public disclosure under the provisions of 10 CFR 2.790.
Some of the information identified as proprietary in this WCAP was marked with a superscript letter "g," thus identifying paragraph "g" of the affidavit as containing an explanation of why the information should be held as proprietary. The affidavit had no paragraph "g."
On or about February 16, 1993, I called your office and was told by a member of your staff that paragraph "g" was left out due to an oversight.
I was also i
told that paragraph "g" should read...
i "The information is not the property of Westinghouse but must be treated as proprietary by Westinghouse according to agreements with the owner."
In order to withhold information as proprietary, we must have a request for withholding by the owner of that information; therefore, it is not possible to withhold WCAP-13522 from public disclosure based solely on your request.
Your staff was informed of this fact by telephone on or about February 24, 1993.
As yet, we have not received a withholding request from the owner of the information identified by superscript letters "g."
