This refers to the inspection conducted by Ms. M. Khanna and Messrs. A. Vegel,
j
F. Brush, and D. Kosloff of this office, on September 13 through October 29,
l
1993, and to the management meeting held in the Region 111 office on
l
October 20, 1993.
The inspection included a review of activities authorized
for your Perry Nuclear Power Plant, Unit 1, facility. At the conclusion of
the inspection, the findings were discussed with those members of your staff
identified in the enclosed report.
Areas examined during the inspection are identified in the report. Within
these areas, the inspection consisted of selective examinations of procedures
i
and representative records, intervieies with personnel, and observation of
activities in progress.
Based on the results of this inspection, certain of your activities appeared
to be in violation of NRC requirements, as specified in the enclosed Notice of
Violation (Notice). The violation is of concern because of the lack of
sensitivity on the part of management and operations personnel to the
importance of controlling electrical transmission yard activities and to the
potential threat to off-site power. Two recent NRC inspection reports
discussed cases of inadequate control of vehicles which had caused severing of
overhead electrical lines at Perry. Additionally, NRC Information Notices
)
90-25, Supplement I and 92-13 and specific communications from this office
[
highlighted the importance of maintaining adequate control over vehicular
i'
traffic to preclude interruption of power supplies.
Your failure to control

vehicular access to the transmission yard is particularly disappointing in
'
light of the previous NRC communications concerning this matter and the two
recent events, which should have raised your staff's sensitivity to such
issues sufficiently to have precluded this latest failure.
During this inspection, certain other of your activities appeared to be in
violation of NRC requirements. However, as described in the enclosed
inspection report, you identified two of these violations. Therefore, the
violations will not be subject to enforcement action because your efforts in
identifying and correcting the violations met the criteria specified in
Section Vll.B of the " General Statement of Policy and Procedure for NRC
Enforcement Actions," (Enforcement Policy, 10 CFR Part 2, Appendix C).

Both non-cited violations involved personnel errors, which are a continuing

NRC concern at Perry.
A third violation, involving examples of failure to
follow maintenance procedures, is considered to be an example of a similar
violation recently cited in inspection report (IR) 50-440/93016 and will not
be subject to additional enforcement action. As we discussed with your staff,
it is expected that the corrective actions proposed in your response to IR 50-
440/93016 will also address the broader causes of the current examples.
This
example is of concern because it indicates continued weaknesses in management
oversight of maintenance activities and of maintenance personnel understanding
the importance of procedural compliance.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your
response, you should document the specific actions taken and any additional
actions you plan to prevent recurrence. After reviewing your response to this
Notice, including your proposed corrective actions and the results of future
inspections, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.
In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of
this letter, the enclosures, and your responses to this letter will be placed
in the NRC Public Document Room.
The responses directed by this letter and the-accompanying Notice are not
subject to the clearance procedures of the Office of Management and Budget as
