l APPENDIX A NOTICE OF VIOLATION Union Carbide Corporation Docket No.70-687 P.O. Box 324 License No. SNM-639 Tuxedo, New York 10987 As a result of the inspection conducted on April 28-30, 1982, and in accord-ance with the NRC Enforcement Policy, 10 CFR 2, Appendix C, the following i
violation was identified:
10 CFR 71.12(b)(ii) requires a person using a shipping package to comply with the terms and conditions of the Certificate of Compliance for the package.
Condition No. 5(b)(1)(xi) of the Certificate of Compliance permits the shipment of irradiated enriched uranium in the isotope U-235 to less than 90 weight percent.
Contrary to the above, on January 12, and March 17, 1982, the licensee shipped licensed material to Savannah River, South Carolina using shipping package BMI-1, Certificate of Compliance No. 5957, which contained uranium enriched in the isotope U-235 to greater than 90 weight percent.
This is a Severity Level V violation (Supplement V.D.2).
Pursuant to the provisions of 10 CFR 2.201, Union Carbide Corporation is hereby required to submit to this office within thirty days of the date of l
this Notice, a written statement or explanation in reply, including:
(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
