Backaround i

By application dated August 13, 1992, B&W Fuel Company (BWFC) requested 'an.

amendment to License SNM-1168 to incorporate its new emergency plan.

The new 1

emergency plan was developed.in accordance with. the requirements of.10 CFR l

70.22(i) and the general guidance provided. in Regulatory Guide 3.67, " Standard

.i Format and Content for Emergency Plans for Fuel Cycle and Material Facilities." By letter dated April 9,1993,. the staff requested' additional j

information.

In response to the request, BWFC provided a' revised Emergency Plan dated August 6,1993 (submitted by. letter dated October 1,1993).

Section 70.22(i) requires licensees to have an emergency plan for responding to the radiological hazards of an accidental release of special nuclear-material and any associated chemical hazards. 'Specifically, the regulations require:

(1) a facility description, (2) a. list of possible types of-t accidents, (3) classification of possible accidents, (4) methods used to detect accidents, (5) procedures for the mitigation of accidents, (6) procedures for assessments of release of material, (7) a description of; plant personnel responsibilities, (8) notification and coordination procedures, (9) training criteria, (10) internal and external communication procedures, (11) safe shutdown procedures, (12) provisions for exercises, and (13) a list of hazardous chemicals onsite.

Regulatory. Guide 3.67 provides general guidance for the above requirements and a standard format for submitting an emergency plan.

While BWFC's current emergency plan meets the intent of 10 CFR 70.22(i), a-new plan was developed to conform to Regulatory Guide 3.67.

In addition, the new plan has been expanded to (1) include the type, form, and-typical quantities of licensed material, (2) describe the chemical usage, (3) describe'the ventilation system, and (4) update the list of postulated-accidents.

The staff has reviewed the emergency plan against the requirements of 10 CFR 70.22(i) and the recommendations of Regulatory Guide 3.67 and-finds that the-plan satisfies those requirements and recommendations and is, thus, acceptable.

Cateoorical Exclusion The staff reviewed the revised Emergency Plan.and determined:

Therefore, in accordance with 10 CFR 51.22(c)(11), neither an environmental l

assessment nor an environmental impact statement is warranted for the proposed action.

Conclusion / Recommendation 4

The st'aff concludes that the amendment meets the requirements of 10 CFR 70.22(i) and can be issued without undue risk to the workers,.public, or the environment.

Therefore, approval of the application is recommended.
