SUBJECT:

REQUEST FOR APPROVAL FOR EXTENSION OF TIME FOR QUALITY ASSURANCE PROGRAM APPROVAL NO. 0608 1

Attached for your review is correspondence from National Installation Services Company dated September 19, 1991, and a Statement of Facts regarding Approval No. 0608. The licensee was billed an annual fee under Invoice No. AM04196-91.

As part of the debt collection review process, it has been determined that this case should not be referred to our debt collection contractor, but rather it should be considered for an extension of time to terminate.

Based on the information furnished, the Office of the Controller recommends tht. you approve the request for an extension of time to terminate for purposes of avoiding the FY 1991 annual fee to September 27, 1991.

Licensed activities ceased prior to September 30, 1991, and the approval was terminated October 4,'1991.

f Upon your approval below, Invoice No. AM04196-91 will be cancelled.

Box 6469 Lakeland, Florida 33807 The licensee sent a letter dated September 19, 1991, stating that they had suspended their radiography license in 1987 and requesting that FY 1991 annual fee Invoice No. AM04196-91, which was issued for Part 71 Quality Assurance Program Approval 0608, be cancelled. The licensee requested termination of Approval 0608 by letter dated September 27, 1991, i

The Final rule revising 10 CFR 170 and 10 CFR 171 provided an opportunity for licensees who wished to relinquish their licenses and who were capable of permanently ceasing licensed operations by September 30, 1991, to avoid the FY,

1991 annual fee if the licensee notified the Commission in writing within the 30-day period prior to the effective date of the rule (56 FR 31475 and 31485; July 10, 1991). As stated in the Federal Register notice, and the notice which was mailed with the invoice, the effective date of the rule was August 9, 1991. Since the request for termination was dated September 27, 1991, it was not considered timely-filed for purposes of avoiding the FY 1991 annual fee.

The bases for the request are: (1) on October 21, 1987, the licensee requested that NRC License No. 09-23042-01 be terminated; (2) License 09-23042-01 was terminated November 18, 1987; (3) on October 27, 1986, the licensee informed the State of Georgia Department of Human Resources that the radiography work I

at Vogtle had been completed; (4) the State's November 4,1986, letter i

suspended activities under Georgia License GA. 920-1; and (5) on September 27, 7

l 1991, the licensee requested that Approval No. 0608 be terminated and referred to the cancellation of the NRC materials license in 1987.

The Office of Nuclear Materials Safety and Safeguards has confirmed that, had they been notified that the materials licenses were terminated, they could have terminated the quality assurance program approval at that time.

Based on l

the information provided, the Commission: (1) grants an extension to the time to file for termination for purposes of avoiding the FY 1991 annual fee to September 27, 1991; (2) acknowledges that no activities covered by Approval No. 0608 were conducted in FY 1991; and (3) acknowledges that Approval No.

0608 was terminated October 4, 1991.

Invoice No. AM04196-91 should be cancelled.
