REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE -
BAW-2192P, " LOW UPPER-SHELF TOUGHNESS FRACTURE MECHANICS ANALYSIS OF REACTOR VESSELS OF B&W OWNERS REACTOR VESSEL WORKING GROUP FOR LEVEL A&B SERVICE LOAD 5" (TAC NO. M87732)
By letter dated August 26, 1993, Babcock and Wilcox Owners Group (B&WOG) provided the subject report, BAW-2192P, on behalf of the B&WOG, Reactor Vessel
-Working Group (RVWG). The report sumarizes the reactor vessel fracture l
l mechanics analysis for the RVWG plants for service load levels A&B.
You have t
requested that the report be reviewed and approved as a topical report tvhich l
some of the RVWG plants may reference as their licensing basis for compliance with 10 CFR Fart 50, Appendix G.
This report supports the RVWG plant's responses to Generic Letter 92-01, " Reactor Vessel Structural Integrity."
You indicated this report was proprietary and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. An affidavit dated August 26, 1993, was prepared by you as Manager, Licensing Services for B&W-Nuclear Technologies, and was provided to support the request to handle the report as proprietary informatior., You indicated, during our telephone conversation on September 15, 1993, that a nonproprietary version of the report will be provided. The B&W Nuclear Technologies (also referred to as the Nuclear Services Company) affidavit stated that the subject report should be exempt from public disclosure for the following reasons:
1.
The information reveals data or material concerning the B&WOG research or development plans or programs of present or potential economic advantage to the B&WOG.
2.
The use of the information by a non-member would decrease his expenditure, in time or resources, in designing, producing, or marketing a similar product.
3.
The information consists of test data or other similar data I
concerning a process, method or component, the application of 1 jg which results in an economic advantage to the B&WOG.

criteria of 10 CFR 2.790 and, on the basis of B&W Nuclear Technologies statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information with the following exception. The copper (w %) and nickel (w %) values in Table 5.2 of the proprietary version of the report will be included in the nonproprietary version of the report.
Therefore, BAW-2192P, " Low Upper-Shelf Toughness Fracture Mechanics Analysis of Reactor Vessels of B&W Owners Reactor Vessel Working Group for Level A & B Service Loads," marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of l
the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copier of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
You should also understand that the NRC may have cause to review this determination in the future, such as if the scope of a Freedom of Information Act request includes your information.
In all review situations, if the NRC needs additional information from you or make a determination adverse to the above, you will be notified in advance of any public disclosure.
