This refers to the inspeci. ion conducted by Messrs. C. J. Paulk, R. B. Vickrey,
l
and Ms. P. A. Goldberg of this office on July 26-30 and August 26, 1993.
The
'
inspection included a review of activities authorized for your Waterford Steam
Electric Station, Unit 3, facility. At the conclusion of the inspection, the
findings were discussed with those members of your staff identified in the
enclosed report.
Areas examined during the inspection are identified in the report. Within
i
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observation of
activities in progress. The results of this inspection are documented in the
enclosed report.
Based on the results of this inspection, certain licensed activities appeared
to be in violation of NRC requirements, as specified in the enclosed Notice of
Violation (Notice). The violation is of concern because the failure to
identify code safety valve setpoints outside of Technical Specifications could
result in the plant operating outside of design basis.
It is our understanding that, during the exit meeting conducted oh July 30,
1993, Mr. J. Hologa, Acting Director, Design Engineering, committed to review
condition identifications and work authorizations that were initiated in the
1988 through 1991 timeframe to verify that the associated design documents
were revised.
If your understanding of this commitment differs from ours,
please contact me immediately.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your
response, you should document the specific actions taken and any additional
actions you plan to prevent recurrence. After teviewing your response to this
Notice, including your proposed corrective actions and the results of future
inspections, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.

During an NRC inspection conducted on July 26-30 and August 26, 1993, a
violation of NRC requirements was identified.
In accordance with the " General
Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2,
Appendix C, the violation is listed below:
!
Criterion V of Appendix B, 10 CFR Part 50, states, in part, that
activities affecting quality shall be prescribed by documented procedures
and shall be accomplished in accordance with these procedures.
Waterford 3 Procedure UNT-005-002, " Administrative Procedure Condition
Reports," Revision 10, states, in Section 4.1.1, that Waterford-3
employees are responsible for "[r]eporting and identifying abnormal
conditions upon observation and initiating a condition identification to
.
obtain resolution. Conditions adverse to quality shall also be further
'
identified as a Nonconformance Condition Identification (NCI)."
Contrary to the above, the licensee failed to identify and initiate
Nonconformance Condition Identifications for the ASME Section III
pressurizer safety valves exceeding the i 1 percent tolerance specified
in the Technical Specifications in December 1986, April 1988, January
'
1991, and June 1992. The licensee also failed to identify and initiate
Nonconformance Condition Identifications for the main steam safety valves
when their as-found set pressures exceeded the i 1 percent tolerance
specified in the Technical Specifications in November 1986, April 1988,
September 1989, and March 1991.
This is a Severity level IV violation (Supplement I) (382/9325-01).
Pursuant to the provisions of In CFR 2.201, Entergy Operations, Inc.,-is
hereby required to submit a written statement or explanation to the U.S.
Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington,'D.C.
20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza
Drive, Suite 400, Arlington, Texas 76011, and a copy to. the NRC Resident
Inspector at the facility that is the subject of this Notice, within 30 days
of the date of the letter transmitting this Notice of Violation (Notice).
This reply should be clearly marked as a " Reply to a Notice of Violation" and
should include for each violation:
(1) the reason for the violation, or, if.
contested, the basis for disputing the violation, (2) the corrective steps
that have been taken and the results achieved, (3) the corrective steps that
will be taken to avoid further violations, and (4) the date when full
compliance will be achieved.
