NOTICE OF VIOLATION

NRC INSPECTION REPORT NO. 50-333/93-18

This refers to the inspection conducted by Mr. J. G. Caruso of this office from September 7

to September 10, 1993. The inspection included a review of activities authorized for your

James A. FitzPatrick facility. At the conclusion of the inspection, the findings were

discussed with those members of your staffidentified in the enclosed report.

Areas examined during the inspection are identified in the report. Within these areas, the

inspection consisted of observation of activities, interviews with personnel, and document

reviews. The purpose of the inspection was to determine whether activities authorized by the

licensee were conducted safely and in accordance with NRC requirements.

Based on the results of this inspection, certain of your activities appeared to be in violation

of NRC requirements, as speci6ed in the enclosed Notice of Violation (Notice). During our

followup of your actions to establish and implement adequate, combustible controls for the

Turbine Track Bay Interim Storage Area, we identi6ed that procedural controls for this area

were not fully implemented. Inadequate combustible controls for this area have been the

subject of previous enforcement action; your actions di&t?d!suffi&ntly correct the prooiua.

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. In your response, you should document the

specific actions taken and any additional actions you plan to prevent recurrence. After

reviewing your response to this Notice, including your proposed corrective actions and the

results of future inspections, the NRC will determine whether further NRC enforcement

action is necessary to ensure compliance with NRC regulatory requirements.
