The 10 Commission here is being asked to act on an order 11 responding to an appeal of the Licensing Board Panel 12 92-4 by the Ohio Citizens for Responsible Energy, 13 Inc., and Susan L.
Hiatt.
14 The Beard decision denied their petition 15 to intervene and for a hearing on the amendment to the 16 operating license for the Perry Nuclear Power Plant.
17 All Commissioners have approved an order 18 attached to the SECY meno dated September 29th which

o 19 grants the appeal and reverses the Licensing Board's 20 denial of the intervention petition. The petitioners' 21 contention is remanded to the Licensing Board for 22 further proceedings to address its adequacy.

4 Licensing Board memorandum and order, Licensing Board 5

In this _ paper the Commission is being 7
asked to act on an order responding to an appeal by 8
the Advanced Medical Systems of:a Licensing Board 9
order which granted an NRC staff motion for summary 10 disposition.
11 All Commissioners have approved an order 12 att. ached to our memorandum of September 29th that 13 affirms the Licensing Board Panel 91-9 in part, 14 reverses the Board's summary disposition of one 15 violation, and remands to the Board for further 16 proceeding all issues relating to that violation.
