SUBJECT:
REQUEST FOR APPROVAL FOR EXTENSION OF TIME FOR EGGERS & ASSOCIATES Attached for your review is correspondence from Eggers & Associates dated October 30, 1991, regarding Quality Approval No. 0619. The licensee was billed an annual fee under Invoice No. AM04359-91.
Based on the information furnished, the Office of the Controller recommends that you approve the request for an extension of time to terminate for purposes of avoiding the FY 1991 annual fee to October 30, 1991.
Licensed activities ceased prior to September 30, 1991, and the approval was terminated October 31, 1991.
Upon your approval below, Invoice No. AM04359-91 will be cancelled.

STATEMENT OF FACTS Licensee:
Eggers & Associates Approval No. 0619 5366 Reserve Drive Dublin, Ohio 43017 The licensee sent a letter dated October 30, 1991, to the Licensing Staff regarding Quality Assurance Program Approval No. 0619.
Although the approval was terminated in accordance with their request, their request that the invoice be " corrected" was not responded to at that time. The letter is considered to be a request for an exemption from the FY 1991 annual fee (Invoice No. AM04359-91).
The final rule revising 10 CFR 170 and 10 CFR 171 provided an opportunity for licensees who wished to relinquish their licenses and who were capable of permanently ceasing licensed operations by September 30, 1991, to avoid the FY 1991 annual fee if the licensee notified the Commission in writing within the 30-day period prior to the effective date of the rule 56 FR 31475 and 31485; July 10, 1991). As stated in the Federal Register notice, and the notice which was mailed with the invoice, the effective date of the rule was August 9, 1991.
Since the request for termination was dated October 30, 1991, it was not considered timely-filed for purposes of avoiding the FY 1991 annual fee.
lhe bases for the request are:
- 1) a cask was manufactured for the Australian government by Eggers Ridihalgh Partners, Inc. (ERPI) and was shipped to Australia in 1988; 2) since early 1988, ERPI decided that they will no longer construct shipping casks; 3) an inspection of ERP'I's subcontractor's cask manufacturing facility was performed in 1988 at the request of the Australian i
government and since that date, ERPI has elected to cease manufacturing shipping casks; 4) the licensee stated that they previously notified the NRC of the above by phone and that the NRC invoice was confusing because it appeared that the licensee would be either the Australian government or the prime contractor, Edlow International Company; 5) the licensee stated that confusion was caused by the fact that the invoice was issued in late summer of l
1991 when actually the fiscal year had begin in 1990; and, 6) the licensee stated that since 1988, they have not given the NRC any indication that they either wanted a license or were engaged in any business activity related to the NRC licensing or certification.
4 Based on the information provided, the Commission: 1) grants an 83-day extension to the time to file for termination for purposes of avoiding the FY 1991 annual fee; 2) acknowledges that licensed activities ceased prior to FY 1991; and, 3) acknowledges the approval was terminated Octoter 31, 1991.
Invoice AM04359-91 should be cancelled.
